«Փաստ» օրաթերթը գրում է

Կրթության, գիտության, մշակույթի և սպորտի նախարարությունն առաջարկում է փոփոխություն կատարել «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքում։ Նշվում է, որ նախագծի ընդունումը պայմանավորված է օտարերկրյա պետությունների բարձրագույն ուսումնական հաստատություններում միջպետական համաձայնագրերով ասպիրանտուրայում սովորողների՝ COVID-19 համավարակով պայմանավորված հետաձգված ուսումնառությունը շարունակելու և գիտական աշխատանքը ավարտելու հանգամանքով: Նշվում է, որ «Զինապարտության մասին» օրենքի 14-րդ հոդվածի 1-ին մասի «գ» կետի համաձայն՝ պարտադիր զինվորական ծառայության զորակոչից ուսումը շարունակելու համար տարկետում տրվում է պետական պատվերով, միջպետական և միջգերատեսչական համաձայնագրերով օտարերկրյա պետությունների բուհերի ուսանողներին, օրդինատուրայում, ինտերնատուրայում, մագիստրատուրայում կամ ասպիրանտուրայում սովորողներին:

Հիմք ընդունելով այս դրույթը՝ կրթության և գիտության նախարարի հրամանների համաձայն, ՀՀ կառավարության և օտարերկրյա պետությունների կառավարությունների միջև մշակույթի, կրթության և գիտության բնագավառներում համագործակցության մասին ծրագրի շրջանակներում ուսանողները գործուղվել են օտարերկրյա պետություններ՝ ասպիրանտական կրթություն ստանալու նպատակով: Պայմանավորված կորոնավիրուսի համավարակով՝ օտարերկրյա պետությունների բուհերում դադարեցվել են ուսումնական գործընթացները, կամ դրանք անցկացվել են հեռավար եղանակով, և սովորողները չեն հասցրել ավարտել ատենախոսական աշխատանքը:

Ընդ որում՝ մի շարք համաձայնագրերի համաձայն՝ եթե նախկինում գործուղված ասպիրանտը կամ դոկտորանտը օբյեկտիվ կամ տեխնիկական պատճառներով (հիվանդություն, տարբեր բնույթի համաճարակներ, թեմայի իրականացման համար անհրաժեշտ տեխնիկական պայմանների բացակայություն, լրացուցիչ գիտափորձերի անցկացման անհրաժեշտություն և այլն) չի հասցրել ավարտել իր գիտական աշխատանքը, ապա կրթաթոշակ տրամադրող երկրի համապատասխան գերատեսչության համաձայնության առկայության դեպքում նախարարության կողմից կրթաթոշակը կարող է երկարաձգվել մինչև մեկ տարի ժամկետով: Նախարարությունը հիշեցնում է, որ եթե քաղաքացուն տարկետում տրվում է մինչև ուսումնառության ավարտը, որը լրանում է, օրինակ, 2020 թվականի սեպտեմբերի 30-ին, վերը նշված պատճառներով պայմանավորված, վերջինիս ուսումնառությունը կարող է երկարաձգվել մինչև մեկ տարի ժամկետով՝ համապատասխանաբար մինչև 2021 թվականի սեպտեմբերի 30-ը, որի ընթացքում, սակայն, լրանում է նրա 27 տարին:

Այս պարագայում, սակայն, առաջանում են հակասություններ օրենքների միջև: Հենց այս պատճառով նախարարությունն առաջարկում է փոփոխություն կատարել «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքում հետագա տարընթերցումներից խուսափելու համար: Այս նախագծի ընդունմամբ կապահովվեն օտարերկրյա պետությունների բարձրագույն ուսումնական հաստատություններում միջպետական համաձայնագրերով ասպիրանտուրայում սովորող քաղաքացիների ուսումնառությունը շարունակելու և գիտական աշխատանքը ավարտելու համար օրենսդրական հիմքերը:
