ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչությունում իրականացված բազմակողմանի քննությամբ պարզվել են «Վարդենիս նյարդահոգեբանական տուն-ինտերնատ» ՊՈԱԿ-ի կադրերի տեսուչի կողմից հոգեկան ֆունկցիաների խանգարման հետևանքով իր արարքի բնույթն ու նշանակությունը մասամբ գիտակցելու հնարավորությունից զրկված անձին աշխատանքային շահագործման ենթարկելու դեպքի հանգամանքները:

 

Քննությամբ ձեռք բերված փաստական տվյալների համաձայն՝ Վարդենիս քաղաքի 65-ամյա բնակչուհին, հանդիսանալով «Վարդենիս նյարդահոգեբանական տուն-ինտերնատ» ՊՈԱԿ-ի կադրերի տեսուչ, իր պաշտոնեական դիրքը օգտագործելով, «Թեթև աստիճանի մտավոր հետամնացություն և վարքային խանգարումներ F-70 սակավամիտ անձնավորություն» ախտորոշմամբ՝ նշված ՊՈԱԿ-ի բնակչուհուն նույն կազմակերպության տարածքում իր կողմից բացված մթերային խանութում առանց աշխատանքային պայմանագրի ընդունել է աշխատանքի՝ որպես վաճառողուհի, ով 2002-2018թթ. ընթացքում աշխատել է նշված խանութում շաբաթվա հինգ օրերին՝ առավոտյան ժամը 10:00-ից մինչև 17:30-ն ընկած ժամանակահատվածում, առանց ընդմիջման: 65-ամյա կինը, օգտվելով ՊՈԱԿ-ի բնակչուհու վիճակի խոցելիությունից՝ չի վարձատրել նրան՝ ենթարկելով աշխատանքային շահագործման:

Ձեռք բերված բավարար ապացույցների համակցությամբ՝ 65-ամյա կնոջը մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 132.2-րդ հոդվածի  (Երեխայի կամ հոգեկան խանգարման հետևանքով իր արարքի բնույթն ու նշանակությունը գիտակցելու կամ դա ղեկավարելու հնարավորությունից զրկված անձի թրաֆիքինգը կամ շահագործումը) 2-րդ մասի 3-րդ կետով: Նրա նկատմամբ որպես խափանման միջոց է կիրառվել չհեռանալու մասին ստորագրությունը:

Նախաքննությունն ավարտվել է, և մեղադրական եզրակացությունը հաստատելու միջնորդությամբ, ուղարկվել դատախազին:
