Ինչպե՞ս պետք է վարձրատրվեք հանգստյան և ոչ աշխատանքային` տոնական և հիշատակի օրերին աշխատելու համար
SOCIETYԱրտաժամյա աշխատանքի յուրաքանչյուր ժամի համար, ժամային դրույքաչափից բացի, վճարվում է հավելում` ժամային դրույքաչափի 50 տոկոսից ոչ պակաս չափով, իսկ գիշերային աշխատանքի յուրաքանչյուր ժամի համար` ոչ պակաս, քան ժամային դրույքաչափի 30 տոկոսի չափով: Այս մասին նշվում է ՀՀ աշխատանքային օրենսգքրի 184-րդ հոդվածում:
Իսկ նույն օրենսգրքի 185-րդ հոդվածի համաձայն հանգստյան և օրենքով սահմանված ոչ աշխատանքային` տոնական և հիշատակի օրերին կատարված աշխատանքը, եթե այն նախատեսված չէ աշխատանքի ժամանակացույցով, կողմերի համաձայնությամբ վարձատրվում է ժամային (օրական) դրույքաչափի կամ գործավարձի առնվազն կրկնակի չափով, կամ աշխատողին մեկ ամսվա ընթացքում տրամադրվում է վճարովի այլ հանգստյան օր, կամ այդ օրը ավելացվում է ամենամյա արձակուրդին:
Նշենք նաև, որ աշխատանքի ժամանակացույցով օրենքով սահմանված ոչ աշխատանքային` տոնական և հիշատակի օրերին կատարված աշխատանքը վարձատրվում է ժամային (օրական) դրույքաչափի կամ գործավարձի առնվազն կրկնակի չափով:
Այս պահանջները չեն տարածվում առողջապահական, հոգաբարձության (խնամակալության), մանկական դաստիարակչական, էներգամատակարարման, գազամատակարարման, ջերմամատակարարման, կապի և աշխատանքի այլ առանձնահատուկ բնույթ ունեցող բնագավառների աշխատողների վրա այն դեպքում, եթե աշխատանքը կատարվում է միմյանց հաջորդող առնվազն հինգ ոչ աշխատանքային (տոնական, հիշատակի, հանգստյան) օրերից որևէ մեկի ընթացքում: Ընդ որում, սույն մասով նախատեսված դեպքում ոչ աշխատանքային օրվա ընթացքում կատարված աշխատանքի դիմաց հավելման չափը որոշվում է կողմերի համաձայնությամբ կամ կոլեկտիվ պայմանագրով:
