Իմ քայլից հայտարարեցին Արմեն Սարգսյանի հնարավոր պաշտոնանկության մասին
BLOGԱԺ «Իմ քայլը» խմբակցության պատգամավոր Վահագն Հովակիմյանը Ֆեյսբուքյան իր էջում գրել է․
«Սահմանադրության 139 հոդվածի համաձայն նախագահն իրավունք ունի հրամանագրի նախագիծն առարկություններով վերադարձնել առաջարկությունը ներկայացրած մարմնին:
Առաջին հայացքից կարող է թվալ Արմեն Սարգսյանը երեկ օգտվել է վերը նշված իր լիազորությունից՝ ԳՇ պետի պաշտոնանկության հրամանագրի նախագիծն՝ իր առարկություններով Վարչապետին վերադարձնելիս:
Բայց ամենևին էլ այդպես չէ: Նախագահը չի կարող կամայական, երբ ցանկանա հրամանագրերի նախագծերը վերադարձնի առաջարկող մարմնին: Կոնկրետ ներկա իրավիճակում Վարչապետը Սահմանադրությամբ (155 հոդված) իրեն տրված լիազորությամբ առաջարկել է զբաղեցրած պաշտոնից ազատել ԳՇ պետին:
Նույնիսկ ամենամիստիկ երևակայությունն ունեցող մարդը չի կարող այս գործընթացում հակասահմանադրության տարրեր տեսնել, թեկուզ՝ առերևույթ:
Իրականում գործ ունենք Նախագահի կողմից իր լիազորությունը կամայական իրացնելու դեպքի հետ, ինչն անթույլատրելի է: Իր լիազորությունները կամայականորեն իրացնելիս Նախագահը կարող է վնասել պետության անվտանգությանը, երկիրը մղել անկայունության, ի չիք դարձնել օրենսդրական բարեփոխումները և այսպես շարունակ:
Վերջին շրջանում Արմեն Սարգսյանի քայլերը կարծես հենց վերը նշված բացասական հետևանքներն առաջացնելուն են միտված: Ուստի, կարելի է արձանագրել, որ առերևույթ հիմքեր կան Արմեն Սարգսյանի պաշտոնանկության գործընթաց սկսելու համար՝ Սահմանադրության կոպիտ խախտման հիմքով (141 հոդված)»:
