POLITICSՀանրապետության նախագահի հայտարարությունը ՀՀ ԶՈւ գլխավոր շտաբի պետ Օնիկ Գասպարյանին պաշտոնից ազատելու առաջարկության վերաբերյալ Հանրապետության նախագահի կայացրած որոշման մասին
Հանրապետության նախագահի կողմից իրեն ներկայացված հրամանագրի նախագիծը առարկություններով վերադարձնելու փաստն անթույլատրելիորեն շահարկվում է և արժանացել է ոչ համարժեք արձագանքի:
Այս կապակցությամբ ևս մեկ անգամ ընդգծում ենք՝ Հանրապետության նախագահն իր գործառույթներն իրականացնում է միմիայն Սահմանադրությամբ սահմանված լիազորությունների միջոցով, անաչառորեն և որոշումները կայացնում է առաջնորդվելով բացառապես համազգային և համապետական շահերով:
Հանրապետության նախագահը չի ներկայացնում որևէ քաղաքական ուժի շահերը, սև կամ սպիտակ չէ, և այդ առումով անթույլատրելի և անընդունելի է ցանկացած շահարկում:
Հանրապետության նախագահի՝ պետության գլխի կարևորագույն առաքելությունն է հետևել Սահմանադրության պահպանմանը և նախագահի ինստիտուտը ծառայեցնել որպես բանակցելու և երկրում ստեղծված իրավիճակի հանգուցալուծման ուղիներ գտնելու հարթակ: Հանրապետության նախագահը բազմիցս առաջարկել է և վերահաստատում է իր պատրաստակամությունը՝ բանակցությունների սեղանի շուրջ համախմբելու քաղաքական ուժերին տարաձայնությունները հարթելու և փոխադարձ ընդունելի լուծումներ գտնելու նպատակով:
Հանրապետության նախագահը ՀՀ ԶՈւ գլխավոր շտաբի պետ գեներալ-գնդապետ Օնիկ Գասպարյանին պաշտոնից ազատելու հրամանագրի նախագիծն իր առարկություններով վերադարձրել է՝ իրացնելով Սահմանադրության 139-րդ հոդվածի 2-րդ մասով սահմանված իր լիազորությունը:
Հիշեցնում ենք, որ Սահմանադրական դատարանն իր 2020թ. մարտի 31-ի ՍԴՈ 1518 որոշմամբ ամրագրել է, որ Հանրապետության նախագահի կողմից Սահմանադրությամբ սահմանված հիմքերով (կարգով) իրականացվող հայեցողական լիազորություններից են զինված ուժերի բնագավառում՝ զինված ուժերի և այլ զորքերի բարձրագույն հրամանատարական կազմը նշանակելու և ազատելու այլընտրանքային լիազորությունը:
Նախագահի առարկությունները չընդունելու վերաբերյալ հիմնավորումները Հանրապետության նախագահի աշխատակազմ են ուղարկվել 2021թ. փետրվարի 28-ին երեկոյան և մուտքագրվել են դրան հաջորդող առաջին աշխատանքային օրը՝ 2021թ. մարտի 1-ին: Հանրապետության նախագահը հրամանագրի նախագծի վերաբերյալ իր դիրքորոշումը կարտահայտի համաձայն Սահմանադրության 139-րդ հոդվածի 2-րդ մասի և օրենսդրությամբ սահմանված ժամկետներում:
