Իմ ունեցած տեղեկություններով, Արմեն Սարգսյանն ու Նիկոլ Փաշինյանը երեկ եկել են համաձայնության՝ իրավական աճպարարության միջոցով իրագործել Նիկոլ Փաշինյանի՝ Օնիկ Գասպարյանին զբաղեցրած պաշտոնից ազատելու ցանկությունը, այս մասին ֆեյսբուքյան իր էջում գրել է «Մեկ Հայաստան» կուսակցության նախագահ Արթուր Ղազինյանը։

«Մասնավորապես, ըստ հաստատված ծրագրի, Արմեն Սարգսյանը չորեքշաբթի կդիմի Սահմանադրական դատարան՝ բայց ոչ թե վարչապետի առաջարկության սահմանադրականությունը ստուգելու, այլ 2018թ-ի հունիսի 11-ին ընդունված Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» ՀՀ օրենքում կատարված փոփոխությունների սահմանադրականությունը վիճարկելու պահանջով։

Հիշեցնեմ, որ 2018թ-ին Մովսես Հակոբյանին զբաղեցրած պաշտոնից ազատելու համար ՀՀ ԱԺ նշված օրենքում կատարեց հետևյալ լրացումը.

«Բարձրագույն հրամանատարական կազմի զինվորական պաշտոնից ազատումը կարող է իրականացվել անկախ այն հանգամանքից՝ առկա են սույն հոդվածի 1-ին մասում սահմանված հիմքեր, թե ոչ»։

Սա նշանակում է, որ Օնիկ Գասպարյանին զբաղեցրած պաշտոնից ազատելու ՀՀ վարչապետի որոշումն օրենքի ուժով կմտնի օրինական ուժի մեջ և Օնիկ Գասպարյանը իրավաբանորեն կդադարի լինել ՀՀ ԶՈւ Գլխավոր շտաբի պետ։

ՀՀ Նախագահին խնդրում, հորդորում և պահանջում եմ ՀՀ Սահմանադրական դատարան ուղարկել բացառապես ՀՀ վարչապետի Ձեզ ներկայացված՝ Օնիկ Գասպարյանին զբաղեցրած պաշտոնից ազատելու մասին առաջարկությունը։

Նշվածից զատ ցանկացած այլ գործողություն կդիտարկվի որպես հարված ՀՀ անվտանգությանն ու ՀՀ Զինված ուժերի մարտունակությանը», – գրել է Ղազինյանը։
