Արմեն Սարգսյանն Օնիկ Գասպարյանի հարցով դիմեց ՍԴ
POLITICSՀանրապետության նախագահը կարևորում է ՀՀ զինված ուժերի գլխավոր շտաբի պետ Օնիկ Գասպարյանին պաշտոնից ազատելու հարցի վերաբերյալ առաջացած քաղաքական ճգնաժամի հրատապ հանգուցալուծումը:
Այդ նպատակով հանդիպումներ են եղել վարչապետի, գեներալ-գնդապետ Օնիկ Գասպարյանի և զինված ուժերի բարձրագույն հրամանատարական կազմի հետ: Ուսումնասիրվել են ազատելու մասին հրամանագրի նախագծի առնչությամբ Նախագահի առարկությունները չընդունելու վերաբերյալ վարչապետի հիմնավորումները:
Ակնհայտ է, որ ստեղծված իրավիճակը արդյունք է պատերազմական և հետպատերազմական ժամանակաշրջանում քաղաքական և ռազմական գործիչների շրջանում առկա տարաձայնությունների՝ երբեմն խիստ անձնավորված մոտեցումներով: Չեն կարող անտեսվել նաև հրամանագրի ստորագրմանն առարկելու համար հիմք հանդիսացած իրավական առումով խնդրահարույց մեկնաբանությունները, իրավակիրառ պրակտիկան, օրենքի հնարավոր բացը:
Հանրապետության նախագահն իր նախորդ հայտարարություններում ընդգծել է, որ խնդրի շուտափույթ և Սահմանադրության շրջանակներում կարգավորումը Հայաստանի և Արցախի անվտանգության ու կայունության համար առաջնային կարևորություն ունի և բացարձակ անհրաժեշտություն է պետականության պահպանման, հասարակության հետագա պառակտումը կանխելու, ժողովրդի միասնությունը և հանրային համերաշխությունը վերականգնելու, ստեղծված անորոշ վիճակից դուրս գալու և վերջնական հանգուցալուծման հասնելու համար:

Միաժամանակ, առաջնորդվելով Սահմանադրության 169-րդ հոդվածի 1-ին մասի 4-րդ կետով, Հանրապետության նախագահն առանձին դիմումով դիմելու է սահմանադրական դատարան «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» 2017թ. նոյեմբերի 15-ի ՀՀ օրենքի՝ Սահմանադրությանը համապատասխանելու հարցը որոշելու խնդրանքով:
Հանրապետության նախագահը, հավատարիմ իր հանձնառությանը, շարունակելու է իրավիճակի հետագա կայունացմանն ուղղված քայլերը և կոչ է անում բոլորին՝ նախագահի ինստիտուտը ծառայեցնելով որպես հարթակ, բանակցել առկա բոլոր խնդիրների համապարփակ լուծումը գտնելու նպատակով:
