Մինչև երբ իրավունք ունի պաշտոնավարելու գեներալ-գնդապետ Օնիկ Գասպարյանը
POLITICSԳեներալ գնդապետ Օնիկ Գասպարյանը Սահմանադրության և օրենքի հիման վրա իրավունք ունի պաշտոնավարել մինչև 2025 թվականի հունիսի 8-ը։ Այս մասին ֆեյսբուքյան իր էջում գրել է Զինծառայողների ապահովագրության հիմնադրամի տնօրեն Վարուժան Ավետիքյանը։
«Գլխավոր շտաբի պետը բարձրագույն հրամանատարական կազմի զինվորական պաշտոն զբաղեցնող միակ զինծառայողն է, ով նշանակվում է 5 տարի ժամկետով` համաձայն «Պաշտպանության մասին» օրենքի 16-րդ հոդվածի 4-րդ մասի: Սա բխում Սահմանադրության 155-րդ հոդվածի 3-րդ մասից, ըստ որի զինված ուժերի զինվորական ամենաբարձր պաշտոնատար անձը գլխավոր շտաբի պետն է, որին վարչապետի առաջարկությամբ նշանակում է Հանրապետության նախագահը՝ օրենքով սահմանված ժամկետով: Ահա և օրենքն էլ սահմանել է 5 տարի ժամկետ, իսկ նախագահն էլ իր 2020 թվականի հունիսի 8-ի ՆՀ-119-Ա հրամանագրով կատարել է 5 տարվա նշանակումը: Ո՛չ Սահմանադրության 133-րդ հոդվածը և ո՛չ էլ «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» օրենքի 40-րդ հոդվածը գլխավոր շտաբի պետի վաղաժամկետ ազատելու դեպքեր չեն նախատեսում, ինչը Սահմանադրության 133-րդ հոդվածի 1-ին մասի պահանջ է, ըստ որի օրենքը պետք է սահմանի նաև ազատման ԴԵՊՔԵՐԸ: Օրենքը դեպք չի սահմանել, այլ 40-րդ հոդվածի 3-րդ կետում լոկ նշել է, որ «Բարձրագույն հրամանատարական կազմի զինվորական պաշտոնից ազատումը կարող է իրականացվել անկախ այն հանգամանքից՝ առկա են սույն հոդվածի 1-ին մասով սահմանված հիմքեր, թե ոչ:» Այսինքն օդից վերցնելով կարելի որոշել, ինչը բնականաբար Սահմանադրության պահանջի խախտում է:
