POLITICSՀՀ ԶՈւ գլխավոր շտաբի պետին պաշտոնից ազատելու միջնորդության վերաբերյալ Հանրապետության նախագահի՝ 02․03․2021թ․ որոշման մասին հայտարարության վերլուծություն.
Նախագահը հայտարարել է Սահմանադրության 139-րդ հոդվածի 2-րդ մասի 2-րդ նախադասությամբ սահմանված իմպերատիվ երկու պահանջներից երկրորդի կատարման մտադրության՝ առանձին դիմումով Սահմանադրական դատարան դիմելու մասին, հիմքը՝ Սահմանադրության 169-րդ հոդվածի 1-ին մասի 4-րդ կետը։
Սահմանադրական դատարանի լիազորությունները սահմանված են Սահմանադրության 168-րդ հոդվածով, որով վերաբերելի կետն առաջինն է, օրենքի համապատասխանությունը որոշելը։ Սահմանադրության 168-րդ հոդվածով Նախագահի հրամանագրի նախագծի սահմանադրականության կամ ՀՀ ԶՈՒ ԳՇ պետին պաշտոնից ազատման հարց լուծելու իրավասություն Սահմանադրական դատարանը չունի, այսինքն՝ Նախագահը վերաբերելիի մասով կարող է դիմել Սահմանադրական դատարան բացառապես «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» 2017թ. նոյեմբերի 15-ի ՀՀ օրենքի (այսուհետ՝ Օրենք)՝ որպես նախագծի իրավական հիմքի՝ Սահմանադրությանը համապատասխանելու հարցը որոշելու խնդրանքով և ոչ կոնկրետ օրենքի հոդվածի կամ մասի։
Սահմանադրական դատարան դիմելու ժամկետ Սահմանադրության 139-րդ հոդվածի 2-րդ մասի 2-րդ նախադասությամբ և վերաբերող մասով Սահմանադրությամբ ընդհանրապես սահմանված չէ։ Վերաբերող մասով ժամկետները սահմանված են Օրենքի 35․1-րդ հոդվածի
3-րդ մասով՝ հրամանագրի նախագծի վերադարձից հետո 8 օր (ազատման հիմք Օրենքի 40-րդ հոդվածի 3-րդ մասը հղում է նշանակման կարգին)։
Հայտարարությամբ Նախագահը գործել է և հայտնել է մտադրությունը գործելու Սահմանադրությանը բացառապես համապատասխան։
