Կենսաթոշակային միջոցները ժառանգելու գործընթացը՝ քայլ առ քայլ
ECONOMICSԿուտակային կենսաթոշակային համակարգի մասնակցի մահվան դեպքում նրա ժառանգը կարող է ստանալ ժառանգված կենսաթոշակային միջոցները։
Իրավաբան.net-ը Abcfinance.am–ից, որը ստեղծվել է ՀՀ կենտրոնական բանկի կողմից, որպես ֆինանսական գիտելիքների և հմտությունների ուժեղացման հանրամատչելի ուղի, տեղեկանում է կենսաթոշակային միջոցները ժառանգելու գործընթացն իրականացվում է հետևյալ քայլերով․
Առաջին քայլ
Ժառանգը պետք է տեղեկություն ստանա ժառանգած կենսաթոշակային միջոցների վերաբերյալ։ Նշյալ տեղեկությունը ստանալու նպատակով նոտարը փոստային եղանակով գրավոր հարցում է ուղարկում Հայաստանի կենտրոնական դեպոզիտարիա, կամ ժառանգն անձամբ է նոտարական հարցումը ներկայացնում Դեպոզիտարիա: Հասցեն՝ ք. Երևան, Վազգեն Սարգսյան 26/1, Էրեբունի պլազա, 5-րդ հարկ:
Երկրորդ քայլ
Դեպոզիտարիան 3 աշխատանքային օրվա ընթացքում պատասխանում է նոտարի գրավոր հարցմանը.
- Կամ ժառանգին անձամբ,
- Կամ նոտարին՝ փոստի միջոցով:
Երրորդ քայլ
Նոտարի տրամադրած ժառանգության վկայագիրը և անձը հաստատող փաստաթղթերը ներկայացվում են Դեպոզիտարիա.
- Ժառանգն անձամբ՝ դիմում ներկայացնելով Դեպոզիտարիային,
- Ժառանգն անձամբ՝ Հաշվի օպերատորների միջնորդությամբ,
- Նոտարը՝ գրավոր, փոստի միջոցով։
Չորրորդ քայլ
Նոտարի կազմած ժառանգության վկայագրում առկա տեղեկատվությունը (ամբողջական լինելու դեպքում) Դեպոզիտարիան գրանցում է Համակարգում այն ստանալուց հետո 2 աշխատանքային օրվա ընթացքում և այդ մասին տեղեկացնում է ժառանգին կամ հաշվի օպերատորին (ում միջոցով փաստաթղթերը փոխանցվել են Դեպոզիտարիա):
Հինգերորդ քայլ
Ժառանգը ժառանգված կենսաթոշակային միջոցները իր բանկային/կենսաթոշակային հաշվին փոխանցելու նպատակով՝ Նոտարի կազմած ժառանգության վկայագիրը և անձը հաստատող փաստաթղթերը, վկայագիրը ստանալուց հետո 1 տարվա ընթացքում ՀԱՇՎԻ ՕՊԵՐԱՏՈՐԻՆ է ներկայացնում ռեեստրավարման համակարգում գրանցվող դիմում։
Վեցերորդ քայլ
«Կուտակային կենսաթոշակների մասին» ՀՀ օրենքի համաձայն՝ Դեպոզիտարիան վերոնշյալ դիմումը ստանալուց հետո 10 աշխատանքային օրվա ընթացքում կազմակերպում է ժառանգված փայերի մարումը և փոխանցում դիմումում նշված բանկային հաշվեհամարին կամ կազմակերպում է ժառանգված փայերի փոխանցումը ժառանգի կենսաթոշակային հաշվին:
Վերոնշյալ քայլերում Ժառանգի փոխարեն կարող է փաստաթղթերը ներկայացնել նաև նրա լիազոր ներկայացուցիչը:
