Կառավարությունն ամրապնդում է ձերբակալված և կալանավորված անձանց իրավունքների ապահովման երաշխիքները

Կառավարությունն առաջարկում է ամրապնդել ձերբակալված և կալանավորված անձանց իրավունքների ապահովման երաշխիքները՝ միաժամանակ ապահովելով Հայաստանի ստանձնած միջազգային պարտավորությունների կատարումը: Ազգային ժողովն առաջին ընթերցմամբ քննարկում է «Ձերբակալված և կալանավորված անձանց պահելու մասին օրենքում» փոփոխություններ և լրացումներ կատարելու մասին օրենքի նախագիծը: Հիմնական զեկուցող, ՀՀ արդարադատության նախարարի տեղակալ Արման Թաթոյանը նշեց, որ առաջարկվող փոփոխությունները ձերբակալված և կալանավորված անձանց հնարավորություն կտան առավել արդյունավետ իրավաբանական օգնություն ստանալ:
«Այսօրվա գործող օրենսդրական կարգավորումները հնարավորություն են տալիս կալանավորված և ձերբակալված անձին տեսակցել միայն իր պաշտպանի հետ: Սակայն գործնականում լինում են իրավիճակներ, երբ կարիք է առաջանում տեսակցել նաև այն փաստաբանի հետ, քրեական գործով ներառված պաշտպան չէ: Օրինակ, փաստաբանը, ով պետք է ստանձնի պաշտպանությունը, այցելել է քրեակատարողական հիմնարկ և պետք է տեսակցի կալանավորված կամ ձերբակալված անձին, քանի որ հրավիրվել է այդ անձի հարազատների կողմից: Այս դեպքում նրա մուտքը հնարավոր կլինի քրեակատարողական հիմնարկ միայն քն նիչի հետ միասին, քանի որ այս առումով հստակ կարգավորումներ չունենք: Եվ ունենում ենք իրավիճակներ, երբ փաստաբանը չի կարողանում տեսակցել պաշտպանյալի հետ՝ կապված քննիչի խանրաբեռնվածության հետ: Այդ իսկ պատճառով մենք առաջարկում ենք, որպեսզի կալանավորված և ձերբակալված անձանց հնարավորություն տրվի տեսակցել նաև քրեական գործով որպես պաշտպան չներգրավված փաստաբանների հետ»,- «Արմենպրես»-ի հաղորդմամբ՝ մանրամասնեց Թաթոյանը:
Արման Թաթոյանը նաև հավելեց, որ առաջարկվող փոփոխություններով կալանավարված և ձերբակալված անձինք հնարավորություն կստանան պաշտպանյալի հետ տեսակցել նաև ոչ աշխատանքային օրերին և ժամերին: «Հիմա տեսակցության ժամերն են 17:00-18:00-ն, իսկ ոչ աշխատանքային և տոն օրերին հնարավոր չէ տեսակցություն կազմակերպել: Մեր կողմից առաջարկվող փոփոխություններով վերանում է այս արգելքը և հնարավորություն է ստեղծվում տեսակցել նաև ոչ աշխատանքային օրերին ու ժամերին»,- մանրամասնեց Թաթոյանը:
