ՀՀ վարչապետ Նիկոլ Փաշինյանի և ԲՀԿ առաջնորդ Գագիկ Ծառուկյանի հանդիպման արդյունքում հայտարարվեց, որ հունիսի 20-ին Հայաստանում կանցկացվեն արտահերթ խորհրդարանական ընտրություններ: Թե ի՞նչ գործընթացներ պետք է տեղի ունենան մինչև ընտրությունները՝ պարզելու համար ԼՈՒՐԵՐ․com-ը զրուցեց սահմանադրագետ Վարդան Այվազյանի հետ։

Պարոն Այվազյան, ի՞նչ գործընթացներ են սպասվում մինչև արտահերթ ընտրությունների կազմակերպումը, ե՞րբ է հրաժարական տալու վարչապետ Նիկոլ Փաշինյանը։

- Ըստ օրենքի՝ Ազգային ժողովի արտահերթ ընտրություններն անցկացվում են ԱԺ-ն արձակվելուց ոչ շուտ, քան 30, և ոչ ուշ, քան 45 օր հետո: Այս ժամկետին գումարվում է 14 օր՝ վարչապետի հրաժարականի գործընթացը: Փաշինյանի հրաժարականը նախատեսվում է ապրիլի 2-րդ կեսին՝ մոտավոր ժամկետն ապրիլի 20-ն է: Համաձայն ԸՕ Հոդված 104.-ի՝ ԱԺ արտահերթ ընտրություններ նշանակելու մասին Հանրապետության նախագահը հրամանագիր է հրապարակում Ազգային ժողովն արձակելու մասին հրամանագրի հետ միաժամանակ: ԱԺ-ի ընտրություններին մասնակցող կուսակցությունները գրանցման համար անհրաժեշտ փաստաթղթերը Կենտրոնական ընտրական հանձնաժողով են ներկայացնում քվեարկության օրվանից ոչ ուշ, քան 25 օր առաջ` մինչև ժամը 18.00-ն: Ընտրություններին մասնակցող կուսակցությունների ընտրական ցուցակների գրանցումը կատարվում է քվեարկության օրվանից ոչ շուտ, քան 25, և ոչ ուշ, քան 20 օր առաջ` մինչև ժամը 18.00-ն: Ընտրական տեղամասերը կազմավորվում, և տեղամասային կենտրոնները սահմանվում են քվեարկության օրվանից ոչ ուշ, քան 25 օր առաջ: Լիազոր մարմինն ընտրողների ցուցակները քվեարկության օրվանից ոչ ուշ, քան 20 օր առաջ հանձնում է տեղամասային կենտրոնի տարածքը տիրապետողին, որն այն փակցնում է տեղամասային կենտրոնում` բոլորի համար տեսանելի տեղում:

Իրավունք կա՞ կայացնել արտահերթ ընտրություններ անցկացնելու մասին որոշում, եթե վարչապետը դեռ հրաժարական չի տվել և  Ազգային ժողովը չի արձակվել։
 
Ի՞նչ տեղի կունենա, երբ, բացի Քաղաքացիական պայմանագրից, բոլոր խմբակցությունները հրաժարվեն ընտրություններից։
 
Երկրում դեռևս արտակարգ դրության և ռազմական դրության իրավիճակ է։ Այս պայմաններում ժամանակ, արտահերթ ընտրություններ կարելի՞ է անցկացնել։
- Արտակարգ դրության ռեժիմը կհանեն, դա խնդիր չէ։ Համաձայնության գալուց հետո կառավարության համար դա 5 րոպեի ընթացքում լուծվող հարց է։
