Սերժ Սարգսյանի գույքը կմնա կալանքի տակ․ դատարանը մերժեց միջնորդությունը

Երևան քաղաքի ընդհանուր իրավասության առաջին ատյանի դատարանի Ավանի նստավայրում այսօր՝ մարտի 19-ին, դատավոր Վահե Միսակյանի նախագահությամբ, հրապարկվեց ՀՀ երրորդ նախագահ Սերժ Սարգսյանի գույքի վրա դրված կալանքը վերացնելու մասին պաշտպանների միջնորդությունը, որը մերժվեց։ «Որոշումը կարող է բողոքարկվել ՀՀ վերաքննիչ քրեական դատարան՝ ստանալուց հետո 10-օրյա ժամկետում»,-ասաց դատավորը։
Հիշեցնենք, որ մարտի 18-ին կայացած դատական նիստի ժամանակ Սերժ Սարգսյանի պաշտպան Ռուբեն Հակոբյանը՝ իր պաշտպանյալի գույքը կալանքից ազատելու մասին միջնորդությունը ներկայացնելիս ասաց․
«2019 թվականի դեկտեմբերի 9-ին քննիչին ներկայացվել է պաշտպանության իրավունքի խախտումները վերացնելու, դատավարական փաստաթղթերին ծանոթացնելու և դրանք պատճեները տրամադրելու մասին միջնորդություն, որի պահանջներից մեկը հանդիսացել է՝ տրամադրել բոլոր այն որոշումների պատճեները, որոնք մեղադրյալի կարգավիճակ ունեցող անձն այդ փուլում ստանալու իրավունք ունի։ 2019-ի Դեկտեմբերի 13-ին և 20-ին ստացվել են քննիչի գրությունն ու միջնորդությունը քննություն առնելու մասին որոշում, որոնցով պաշտպանության կողմին չի տրամադրվել պահանջվող, տրամադրման ենթակա որոշումների պատճեները, որոնց թվին է դասվում գույքի վրա կալանք դնելու մասին որոշումը։ 2019-ի դեկտեմբերի 18-ի երեկոյան էլեկտրոնային մամուլից տեղեկացել ենք, որ քննիչի կողմից Սարգսյանի, Բեգլարյանի գույքի վրա կալանք է դրվել։ Դրանից մեկ օր անց պաշտպան Ամրամ Մակինյանը միջնորդություն է ներկայացրել նախանքննական մարմին՝ տրամադրել Սերժ Սարգսյանի գույքի վրա կալանք դնելու մասին որոշման օրինակը և ծանոթացնել հավաքված այն ապացույցներին, որոնք հիմք են տալիս ենթադրելու, որ Սարգսյանը կարող է թաքցնել, փչացնել կամ սպառել բռնագրավման ենթակա գույքը։ Դեկտեմբերի 16-ին ստացվել է քննիչի միջնորդությունը մասնակի մերժելու մասին որոշումը, որով պաշտպանի նույնաբովանդակ երրորդ միջնորդությունը մասնակի մերժվել է, տրամադրվել է մեղադրյալի գույքի վրա կալանք դնելու մասին որոշման օրինակը, որն այդքան ժամանակ գաղտնի էր պահվում պաշտպանության կողմից»։
Նա նաև հայտնեց, որ իր պաշտպանյալի գույքի վրա կալանք դնելիս խախտվել են տվյալ դատավարական հարկադրանքի միջոցի կիրառումը կանոնակարգող, Քրեական դատավարության օրենսգրքի բազմաթիվ հոդվածներ։ Կալանք դրվել է 489 միլիոն 160 հազար 310 դրամի սահմանաչափով շարժական ու անշարժ գույքի և ֆինանսական միջոցների վրա, բաժնեմասերի, արժեթղթերի վրա։
Հաջորդ նիստը կկայանա ապրիլի 15-ին ժամը 14։00-ին։
