ԶՈւ ԳՇ նորանշանակ պետ Արտակ Դավթյանի ուղերձը
POLITICSԶՈւ ԳՇ նորանշանակ պետ Արտակ Դավթյանը ուղերձով է հանդես եկել, որում նշվում է․
«44-օրյա հերոսական և անձնուրաց պատերազմից հետո մեր երկրի և Արցախի անվտանգության համակարգի վերագնահատման և ամրապնդման ուղղությամբ սկսված աշխատանքների շարունակականությունն ապահովելու, արտաքին սպառնալիքները չեզոքացնելու առումով ՀՀ զինված ուժերը կատարել և շարունակելու է կատարել իր առջև դրված խնդիրները։
Զինված ուժերի ղեկավար կազմի հայտնի հայտարարությունից հետո ստեղծված իրավիճակը հանգուցալուծվեց, իսկ առկա տարաձայնությունները տեղափոխվեցին իրավական դաշտ։
ՀՀ զինված ուժերը, ունենալով Կառավարության ենթակայության և քաղաքացիական վերահսկողության ներքո գտնվելու սահմանադրական կարգավիճակ, քաղաքական հարցերում պահպանելու է չեզոքություն՝ բացառապես առաջնորդվելով Հայաստանի Հանրապետության պաշտպանությունը, անվտանգությունը, տարածքային ամբողջականությունն ու սահմանների անձեռնմխելիությունն ապահովելու բացառիկ պարտականությամբ»,-նշված է հայտարարության մեջ։
Հիշեցնենք, որ այսօր վարչապետ Նիկոլ Փաշինյանը հայտարարությամբ էր հանդես եկել, որում ասվում է․
«Առաջնորդվելով Սահմանադրության և «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» ՀՀ օրենքի վերաբերելի դրույթներով՝ վարչապետի կողմից 2021թ. մարտի 10-ին Հանրապետության նախագահին էր ներկայացվել առաջարկություն՝ Արտակ Դավթյանին ՀՀ ԶՈՒ գլխավոր շտաբի պետ նշանակելու վերաբերյալ՝ կցելով համապատասխան հրամանագրի նախագիծը:
2021թ. մարտի 11-ին վարչապետի աշխատակազմ են մուտք եղել Հանրապետության նախագահի առարկությունները վերոնշյալ նախագծի վերաբերյալ:
Հանրապետության նախագահի կողմից ներկայացված առարկությունները վարչապետի կողմից չեն ընդունվել, ինչի մասին նույն օրը գրություն է ուղարկվել Հանրապետության նախագահին՝ համապատասխան հիմնավորումներով:
Հաշվի առնելով այն հանգամանքը, որ «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» ՀՀ օրենքի 35.1-ին հոդվածի 3-րդ մասով սահմանված ժամկետներում Հանրապետության նախագահը չի ստորագրել վարչապետի կողմից ներկայացված նախագիծը և չի դիմել Սահմանադրական դատարան, ղեկավարվելով Սահմանադրության 139-րդ հոդվածի 3-րդ մասով, ինչպես նաև «Զինվորական ծառայության և զինծառայողի կարգավիճակի մասին» ՀՀ օրենքի 35.1-ին հոդվածի 6-րդ մասով՝ 2021թ. մարտի 22-ից Արտակ Դավթյանն իրավունքի ուժով համարվում է նշանակված ՀՀ ԶՈՒ գլխավոր շտաբի պետի պաշտոնին»:
Հիշեցնենք, որ նախագահը հայտարարել էր՝ չի ստորագրելու հրամանագրի նախագիծը և չի դիմելու Սահմանադրական դատարան:
