«Փաստ» օրաթերթը գրում է

ՍԴ-ի հայտնի որոշումից հետո, իրավական բոլոր նորմերով, հաջորդ գործընթացը պետք է լիներ առաջին ատյանի դատարանի կողմից քրեական հետապնդումը դադարեցնելը, սակայն, ինչպես տեսնում ենք, զարգացումներն այլ ուղղությամբ են ընթանում։ Նախ՝ դատախազներն առանց հիմնավորման բացակայեցին դատական նիստից, իսկ երեկ հայտնի դարձավ, որ ՀՀ գլխավոր դատախազ Արթուր Դավթյանը Ռոբերտ Քոչարյանի և մյուսների վերաբերյալ քրեական գործով դիմել է Սահմանադրական դատարան։ Ըստ դատախազության, «Սահմանադրական դատարանի որոշումից հետո միայն հնարավոր կլինի դատավարական լեգիտիմ դիրքորոշում ձևավորել սույն քրեական գործով ամբաստանյալների քրեական հետապնդման հետագա ճակատագրի հարցում»: Եթե պարզ, հանրամատչելի լեզվով բացատրենք, ապա փաստացի դատախազը ցանկանում է առաջադրված մեղադրանքները վերաձևակերպելու, վերաորակելու և այլ հոդվածով մեղադրանք առաջադրելու հնարավորություն ստանալ ՍԴ-ի միջոցով։ Սակայն, սահմանադրագետների կարծիքով, գլխավոր դատախազը դատական քննության փուլում իրավունք չուներ դիմել Սահմանադրական դատարան։

«Փաստ» թերթի տեղեկություններով, քաղաքական իշխանությունից հստակ հանձնարարական է իջեցվել ամեն ինչ անել, որպեսզի Մարտի 1-ի դատական գործում մեղադրանքի վերաորակում իրականացվի, և գործը կարճելու մասին խոսք անգամ չլինի։ Մեր աղբյուրների փոխանցմամբ, հարցի «կարգավորման» գործում ակտիվ ներգրավված է ԲԴԽ անդամ Գագիկ Ջհանգիրյանը: Ի դեպ, ավելորդ չէ նշել, որ վերաորակման թեզն ի սկզբանե ակտիվորեն շրջանառում էին, այսպես կոչված, սորոսականներն ու ընդհանրապես մշտապես արևմտյան ֆինանսավորում ստացող որոշ անհատներ, որոնք, իրար հերթ չտալով, չէին էլ թաքցնում իրենց կատաղությունը ՍԴ-ի որոշման հետ կապված:
