Բարձրագույն կրթության եւ գիտության մասին օրենքը Հանրապետության նախագահին է ուղարկվել ժամկետների խախտումով

Բարձրագույն կրթության եւ գիտության մասին ՀՀ աղմկահարույց օրենքը Հանրապետության նախագահին է ուղարկվել ժամկետների խախտումով՝ երկու օր ուշացումով։ Իսկ սա նշանակում է, որ Արմեն Սարգսյանը պարտավոր է հայտարարել այդ մասին, օրենքը ետ ուղարկել Ազգային ժողով, որից հետո այն ըստ ամենայնի պետք է դուրս գա շրջանառությունից եւ խորհրդարանում «զրոյից» դրվի քննարկման։ Մեր տեղեկությունները հաստատեց ԱԺ «Լուսավոր Հայաստան» խմբակցության պատգամավոր Աննա Կոստանյանը, ով առավոտյան է նախագահականից պարզել, որ ԱԺ-ն նախագիծն ուղարկել է ապրիլի 2-ին, մինչդեռ վերջնաժամկետը մարտի 31-ն էր։
Համաձայն ԱԺ կանոնակարգի՝ խորհրդարանի կողմից ընդունված նախագիծը նախագահի հաստատմանն է ներկայացվում յոթօրյա ժամկետում, կանոնակարգ-օրենքում, ուշադրություն՝ չի շեշտվում «աշխատանքային» օրվա մասին, հետեւաբար հաշվարկն իրականացվում է օրացուցային օրերով, իսկ հայտնի օրենքը խորհրդարանում ընդունվել է մարտի 24-ին․
«Ինձ եւ նախագահականի, եւ Ազգային ժողովի ընդհանուր բաժնից փոխանցեցին, որ ապրիլի 2-ին է ուղարկվել, իսկ սա նշանակում է՝ երկու օր ուշացումով։ Նման դեպքում, բնականաբար, նախագահը պետք է հետ վերադարձնի օրենքը, որովհետեւ սա նշանակում է, որ սահմանադրի իրավունքները խախտվել են, այսինքն օրենսդրի մարմինն ինքը խախտել է՝ իր կողմից նշված ժամկետները։ Օրինակ, նախագիծը առաջինից երկրորդ ընթերցման ներկայացնելու համար եւս ժամկետներ են սահմանված, եթե դրանք չեն պահպանվում, ապա նախագիծը հանվում է շրջանառությունից, նորից զրոյից բերվում է օրակարգ։ Այս դեպքում էլ՝ իմ պատկերացմամբ նույնն է լինում։ Սա նշանակում է, որ սույն օրենքի վավերականության ժամկետն ավարտվել է, ժամկետներ են խախտվել եւ նախագահն իր լիազորությունները չի կարողացել կատարել պատշաճ ժակետներում, հետեւաբար օրենքի վավերականության ժամկետն անցել է ու պետք է դուրս գա շրջանառությունից։ Օրենքը, ըստ էության, մնում է օդում կախված եւ պետք է զրոյից մտցնեն օրակարգ»։
Նշենք, որ այսօր ԵՊՀ-ն եւ ԳԱԱ-ն նախագահին ուղղված կոչով են հանդես եկել, որպեսզի օրենքի վերաբերյալ դիմի Սահմանադրական դատարան։
