Արմեն Սարգսյանը հայտարարություն է տարածել
POLITICS««Հայաստանի Հանրապետության դատական օրենսգիրք» սահմանադրական օրենքում լրացումներ և փոփոխություններ կատարելու մասին» օրենքը (այսուհետ՝ Օրենք) և հարակից օրենքները Ազգային ժողովի կողմից Հանրապետության նախագահի ստորագրմանն են ներկայացվել 2021թ. մարտի 22-ին:
Հանրապետության նախագահը Օրենքը քննարկել է արդարադատության նախարարի, Ազգային ժողովի պետական-իրավական հանձնաժողովի նախագահի հետ և ստացել նրանց պարզաբանումները: Օրենքը քննարկվել է նաև ԲԴԽ նախագահի, իրավաբան գիտնականների, փորձագետների և փաստաբանների, քաղաքացիական հասարակության ներկայացուցիչների հետ, լսվել են նրանց նկատառումներն ու մտահոգությունները:
Հանրապետության նախագահը մեծապես կարևորում է դատաիրավական ո ոլորտում բարեփոխումները և գտնում է, որ դրանք պետք է կատարվեն համակարգային ձևով՝ հստակ ռազմավարության հիման վրա՝ ընդհանուր տեսլականի շրջանակում: Այդ տեսլականը և ռազմավարությունը պետք է հիմնված լինեն գործնականում առկա և իսկապես արդիական խնդիրների, փորձագիտական ուսումնասիրությունների և միջազգային փորձի լուրջ վերլուծության վրա, առաջարկեն համակարգային և տրամաբանորեն փոխկապակցված լուծումներ՝ ուղղված դատական համակարգի դերի և գործունեության արդյունավետության բարձրացմանը, արդար դատաքննության իրավունքի արդյունավետ իրացմանը, ինչպես նաև դատավորների անկախության ու անձեռնմխելիության երաշխիքների ամրապնդմանը:
Օրենքով առաջարկվող կարգավորումներն իրավիճակային են և առերևույթ խնդրահարույց իրավական որոշակիության, համաչափության, իշխանությունների տարանջատման, ինչպես նաև դատական իշխանության անկախության սահմանադրական սկզբունքներին և պահանջներին համապատասխանելու տեսանկյունից:
Ելնելով վերոհիշյալից և ամփոփելով փորձագիտական եզրակացությունները՝ կարելի է եզրահանգել, որ Օրենքը առերևույթ հակասում է Սահմանադրությանը, ուստի Հանրապետության նախագահը որոշել է դիմել Սահմանադրական դատարան «Հայաստանի Հանրապետության դատական օրենսգիրք» սահմանադրական օրենքում լրացումներ և փոփոխություններ կատարելու մասին» օրենքի և հարակից օրենքների՝ Սահմանադրության համապատասխանության հարցը որոշելու խնդրանքով:
