«Փաստ» օրաթերթը գրում է

Սպառողների իրավունքների և օրինական շահերի պաշտպանությունը շատ կարևոր է։ «Փաստն» իր «Լինել իրազեկ» խորագրի ներքո ներկայացնում է սպառողների իրավունքները և պարտականությունները։ Այս համատեքստում համագործակցում ենք «Սպառողների ասոցիացիա» ՀԿ-ի իրավաբան Սյուզաննա Չիլինգարյանի հետ: Այս անգամ անդրադարձել ենք մի խնդրի, որին շատ սպառողներ են առնչվել։ Երբեմն պատահաբար կարող ես խանութում ձեռքով կամ պայուսակով դիպչել դարակին, որի վրա դրված, օրինակ՝ գինին ընկնի հատակին և կոտրվի։ Ի՞նչ է հաջորդում սրան։ Բնականաբար, խանութի վաճառողը պահանջում է վճարել կոտրված գինու արժեքը։ Արդյո՞ք նա ունի այդ իրավունքը։

Սյուզաննա Չիլինգարյանից հետաքրքրվում ենք՝ ո՞ր դեպքում պետք է վճարել, եթե խանութում որևէ ապրանք ենք կոտրել կամ վնասել։ «Եթե խանութում շրջելու ընթացքում պատահաբար դիպել եք դարակին, որի վրա դրված իրերից ինչ-որ բան, ընկնելով հատակին, անզգուշաբար կոտրվել է, ապա դուք մեղավոր չեք և մի շտապեք վճարել դրա համար։ Այդպիսի դեպքերում խանութի ադմինիստրացիան պարտավոր է պահել անվտանգության կանոնները, որովհետև գոյություն ունեն ապրանքի դասավորության հստակ ստանդարտներ։ Դրանք կարգավորվում են ԳՕՍՏ 51773-2001-ով։ Օրինակ. 1) Դարակների վրա դրված մթերքներն անկայուն են, 2) Դարակների միջև հեռավորությունը 1,4 մետրից քիչ է (մինչև 100 քմ մակերեսով խանութներում) կամ 1,6մ – 100-150քմ, 2 մ – 150-400 քմ, քիչ է 2,5մ-ից (մինչև 400 քմ մակերեսով խանութներում), 3) Հատակը սահուն էր, 4) Անցումը փակված էր տուփերով կամ ապրանքի կույտերով, 5) Ապրանքը կոտրվել է դրամարկղի ժապավենի վրայից ընկնելով»,-«Փաստի» հետ զրույցում ասում է Չիլինգարյանը։

Միևնույն ժամանակ մեր զրուցակիցը նշում է՝ կան դեպքեր, երբ անձը պարտավոր է վճարել կոտրված ապրանքի համար։ «Քաղաքացիական օրենսգրքի 17-րդ՝ վնասների հատուցման մասին հոդվածի համաձայն, այնուամենայնիվ, վնաս պատճառելը պետք է հատուցվի, եթե այն միտումնավոր է արված, հակառակ դեպքում անձը պարտավոր չէ վճարել։ Օրինակ՝ անզգուշաբար անցնելով, շուռ եք տվել դարակի ծայրին դրված ոգելից խմիչքի շիշը: Հետևեք՝ արդյո՞ք դարակի վրա կան հատուկ ելուստներ՝ ապրանքը ամուր պահելու համար, եթե՝ ոչ, ապա մեղավոր չեք: Եթե խանութի աշխատակիցները շարունակում են ձեզ պարտավորեցնել վճարել գումարը կամ ձեզ է մոտենում անվտանգության աշխատակիցը, ապա թույլ մի տվեք, որ նրանք ձեզ վախեցնեն կամ սպառնան, քանի որ միայն դատարանն իրավունք ունի պարտավորեցնել անձին վճարել այս կամ այն ապրանքի համար»,-եզրափակում է Սյուզաննա Չիլինգարյանը:
