Վարորդները այլևս 12.000 դրամ չեն վճարի․ Ոստիկանության նոր նախագիծը՝ համարանիշերի վերաբերյալ
SOCIETYՈստիկանությունը հանրային քննարկման է ներկայացրել կառավարության որոշման մեջ փոփոխություններ կատարելու նախագիծը։
Կհանվի «Պետական տուրքի մասին» օրենքի 16-րդ հոդվածով սահմանված ավտոմոբիլի հաշվառման համարանիշ (բացառությամբ տարանցիկ և ժամանակավոր համարանիշի) հատկացնելու համար՝ որպես պետական տուրք նախատեսված վճարման ենթակա 12.000 ՀՀ դրամ պետական տուրքի վճարման օրենսդրական պահանջը։
Հիմնավորման մեջ նշվում է, որ ՀՀ կառավարության 2010 թվականի սեպտեմբերի 9-ի N 1251-Ն որոշման ներկայիս գործող կարգավորումների համաձայն՝ ձեռք բերվող տրանսպորտային միջոցի պետական գրանցումը և հաշվառումը պետք է իրականացնի Ճանապարհային ոստիկանության իրավասու ստորաբաժանում և «Պետական տուրքի մասին» օրենքի 16-րդ հոդվածի համաձայն՝ ավտոմոբիլի հաշվառման համարանիշ (բացառությամբ տարանցիկ և ժամանակավոր համարանիշի) հատկացնելու համար վճարի 12.000 ՀՀ դրամ որպես պետական տուրք՝ անկախ հատկացվող համարանիշի ցանկալի համարվելու համար վճարման ենթակա օրենսդրությամբ հաստատագրված լրացուցիչ գումարի վճարումից։
Ներկայումս առաջարկվում է ՀՀ կառավարության սահմանված կարգով նախատեսել պայմաններ հաշվառվող տրանսպորտային միջոցի նախկին սեպականտիրոջ համաձայնության դեպքում չփոխարինել հաշվառվող տրանսպորտային միջոցի հերթական կամ ցանկալի համարանիշերը։
«Հայաստանի Հանրապետության կառավարության 2010 թվականի սեպտեմբերի 9-ի N 1251-Ն որոշման մեջ լրացում կատարելու մասին» ՀՀ կառավարության որոշման ընդունմամբ ակնկալվում է պետական բյուջեում եկամուտների էական նվազեցում, քանի որ «Պետական տուրքի մասին» օրենքի 16-րդ հոդվածի համաձայն՝ ավտոմոբիլի հաշվառման համարանիշ (բացառությամբ տարանցիկ և ժամանակավոր համարանիշի) հատկացնելու համար վճարման է ենթակա 12.000 ՀՀ դրամ որպես պետական տուրք և անկախ հատկացվող համարանիշի ցանկալի կամ մեծ պահանջարկ ունեցող համարվելու համար վճարման ենթակա օրենսդրությամբ հաստատագրված լրացուցիչ գումարի վճարումից, պետական տուրքի գումարը մշտապես ենթակա է վճարման։
Միայն 2020 թվականի ընթացքում ՀՀ-ում տրանսպորտային միջոցի ցանկալի (36.000 ՀՀ դրամ արժողությամբ) հաշվառման համարանիշով հաշվառվել է 20.514 տրանսպորտային միջոց, հետևաբար ՀՀ պետական բյուջե գանձվել է 738.504.000 ՀՀ դրամ գումար, իսկ օտարված տրանսպորտային միջոցի համարանիշի փոփոխությամբ՝ հերթական համարանիշ է հատկացվել 81.032 տրանսպորտային միջոցի, ուստի ՀՀ պետական բյուջե գանձվել է 972.384.000 ՀՀ դրամ գումար։
Ընդհանուր 2020 թվականի ընթացքում ցանկալի և հերթական համարանիշերի հատկացման արդյունքում որպես պետական տուրք ՀՀ պետական բյուջե գանձվել է 1.218.552.000, իսկ ընդհանուր առմամբ՝ 1.957.026.000 ՀՀ դրամ գումար։
