Ինչո՞ւ է նախագահը խուսափում իր լիազորությունից. պայմանավորվածություն Փաշինյանի հե՞տ
INTERVIEWԱպրիլի 25-ին՝ Քաղաքացու օրը, Նիկոլ Փաշինյանը հայտարարեց իր հրաժարականի և հունիսի 20-ին կայանալիք արտահերթ խորհրդարանական ընտրությունների մասին:
ԼՈՒՐԵՐ.com-ի հետ զրույցում սահմանադրագետ Գոհար Մելոյանը վարչապետի կողմից ընտրության օր նշանակելը տարօրինակ է համարում, քանի որ նա չունի դրա սահմանադրական լիազորությունները:
«Հիշում ենք, որ, մոտավորապես, երկու ամիս առաջ Նիկոլ Փաշինյանը առաջին անգամ հայտարարեց ընտրության օրը, բայց բնավ զարմանալի չէր, որ նա, որպես իշխանության ղեկավար և վարչապետ, որերորդ անգամ կատարում է լիազորություններ, որոնք օրենքով և Սահմանադրությամբ իրեն վերապահված չեն: Հատկապես, խնդրահարույց է, որ Սահմանադրությունը անգամ Ազգային ժողովի լուծարման պարագայում հստակ օր չի սահմանում. ընտրությունները նշանակվում են ԱԺ-ի լուծարումից հետո ոչ շուտ, քան 30 և ոչ ուշ, քան 45-րդ օրը: Հավանաբար, այդ ձևաչափով էլ իրենք իրենց համար օր են հաշվարկել: Սովորույթի համաձայն՝ ընտրությունները տեղի են ունենում կիրակի, և հունիսի 20-ն էլ հենց կիրակի է»,- նկատեց Մելոյանը:
Ըստ Սահմանադրության՝ ընտրությունների օր նշանակելու լիազորությունը երկրի նախագահինն է՝ Ազգային ժողովի լուծարման դեպքում. «Սա ավելի շատ հռչակագրային լիազորություն է և պարտականություն, որովհետև Սահմանադրությունը գործողության այլընտրանք չի տալիս, օրինակ, օրենքների ստորագրման դեպքում նախագահը հնարավորություն ունի կա՛մ դրանք չստորագրելու, կա՛մ Սահմանադրական դատարան ներկայացնելու, իսկ այս պարագայում իմպերատիվ նորմ է, համաձայն որի, նախագահն է նշանակում ընտրությունների օրը»,- նշեց սահմանադրագետը:
Մելոյանը չի բացառում վարչապետի ու նախագահի հնարավոր պայմանավորվածությունը՝ ընտրությունների օր նշանակելու վերաբերյալ. «Մենք բազմիցս ականատես ենք եղել, որ նախագահն իր սահմանադրական բուն առաքելությունից փորձում է զերծ մնալ և փոխհամաձայնության է եկել Փաշինյանի հետ, ուստի կարելի է նման եզրահանգում անել: Այս իրավիճակից ելնելով՝ իրենք քաղաքական կոնսենսուսի են եկել խորհրդարանական ընդդիմադիր ուժերի հետ»:
