Արցախի ՄԻՊ-ն ուղերձ է հղել
POLITICSԱրցախի Հանրապետության մարդու իրավունքների պաշտպանն ուղերձ է հղել Աշխատանքի օրվա առթիվ:
«Սիրելի՛ հայրենակիցներ, շնորհավորում եմ բոլորիս Մայիսի 1-ի՝ Աշխատանքի օրվա առթիվ։ Աշխատասիրությունը, աշխատանքի և աշխատող մարդու նկատմամբ հարգանքը մեր ազգային ինքնատիպ առանձնահատկություններից են, որը մշտապես պետք է պահպանենք՝ մեր ընտանքիների և պետության ամրապնդման համար։
Աշխատանքի օրն առիթ է բարձրաձայնելու այն խնդիրները, որոնց բախվում են աշխատավոր մարդիկ Արցախում, քանզի աշխատանքային իրավունքների իրացումը և աշխատանքի արդարացի պայմանները կարևոր են հասարակական հարաբերությունների ներդաշնակության, սոցիալական արդարության ամրապնդման և պետության կայուն զարգացման համար։
Աշխատանքային իրավունքների պաշտպանության համար Արցախում առկա են օրենսդրական բավարար երաշխիքներ, սակայն մի շարք դեպքերում արձանագրվել և դեռևս շարունակվում են նկատվել աշխատանքային իրավունքների այնպիսի խախտումներ, որոնք կարող էին բացառվել աշխատանքային իրավահարաբերությունների մասնակիցների՝ աշխատանքային իրավունքների պաշտպանության մեխանիզմների մասին բավարար իրազեկվածության պարագայում:
2020թ. Մարդու իրավունքների պաշտպանը ստացել էր աշխատանքային իրավունքներին առնչվող 75 դիմում, որոնք հիմնականում վերաբերել են աշխատանքային պայմանագիրն անհիմն լուծելուն, առանց իրավաչափ հիմքի հաստիքների կրճատմանը, վերջնահաշվարկ չտրամադրելուն, առանց օրենքով սահմանված ընթացակարգի պահպանման՝ կարգապահական տույժերի ենթարկելուն։ Սոցիալ-տնտեսական վիճակով ու թափուր աշխատատեղերի սակավությամբ պայմանաորված, ինչպես նաև աշխատաշուկայի անբավարար լինելու պատճառով հաճախ աշխատողները ստիպված են եղել համակերպվել իրենց աշխատանքային իրավունքների ոտնահարման փաստի հետ։
Իրավիճակն ավելի են բարդացնում 2020թ.-ի աշնանը Արցախի ժողովրդի դեմ սանձազերծված ադրբեջանական ագրեսիայի հետևանքները՝ Ադրբեջանի օկուպացիայի տակ հայտնված տարածքներից Արցախի հազարավոր աշխատավորներ զրկվել են բնականոն պայմաններում իրենց աշխատանքային իրավունքները իրացնելու հնարավորությունից, իրենց արժանապատիվ զբաղմունքից զրկվել են գյուղատնտեսության ոլորտում աշխատող մեր հայրենակիցները։
Նման պայմաններում առավել մեծ ջանքեր են պահանջվում աշխատանքի շուկայի բարելավման և հասարակությանը արժանապատիվ աշխատանքով ապահովելու համար։
Վերստին շնորհավորելով օրվա առթիվ՝ մաղթում եմ, որ մեր ամենօրյա աշխատանքով կարողանանք ոտքի կանգնեցնել և շենացնել մեր հայրենիքը և կառուցել մրցունակ պետություն՝ ապահովելով աշխատանքի կազմակերպման և աշխատավորների իրավունքների պաշտպանության արդի մեթոդներն ու չափանիշները»:
