ՄԻԵԴ Մեծ պալատը կքննի Հայաստանի և Ադրբեջանի փոխադարձ բողոքները
INTERNATIONAL NEWSՄարդու իրավունքների եվրոպական դատարանի Մեծ պալատը քննարկման համար ընդունել է Մարդու իրավունքների եվրոպական կոնվենցիայի ոտնահարումների մեղադրանքներով Հայաստանի և Ադրբեջանի բողոքները միմյանց դեմ: «Արմենպրես»-ի հաղորդմամբ` այս մասին ասված է ՄԻԵԴ-ի պաշտոնական կայքում հրապարակված մամուլի հաղորդագրությունում:
Մասնավորապես, նշվում է, որ Մեծ պալատը կուսումնասիրի երկու միջպետական գործերը:
Նշվում է, որ դիմումները վերաբերում են հիմնականում Հայաստանի և Ադրբեջանի միջեւ վերջին ռազմական գործողություններին և պարունակում են ռազմական գործողությունների ընթացքում Կոնվենցիայի համատարած խախտումների մասին մեղադրանքներ, այդ թվում՝ հարձակումներ քաղաքացիական անձանց, ինչպես նաև քաղաքացիական և հանրային ունեցվածքի ու ենթակառուցվածքների վրա, զինվորների և խաղաղ բնակիչների նկատմամբ վատ վերաբերմունք և խեղումներ, գերեվարում և ռազմագերիների շարունակական պահում, քաղաքացիական բնակչության բռնի տեղահանություն ռազմական գործողություններից տուժած տարածքներից:
«Հայաստանն ընդդեմ Ադրբեջանի» դիմումը Մարդու իրավունքների եվրոպական դատարան է ներկայացվել 2020 թվականի սեպտեմբերի 27-ին, իսկ «Ադրբեջանն ընդդեմ Հայաստանի» դիմումը՝ 2020 –ի հոկտեմբերի 27-ին:
«Նշված միջպետական գործերի համատեքստում Դատարանը միջնորդություններ էր ստացել՝ միջանկյալ միջոցներ ձեռնարկելու վերաբերյալ: Հաշվի առնելով կարծիքը, որ իրավիճակը Կոնվենցիայի լուրջ խախտումների ռիսկ է առաջացրել, դատարանը ժամանակավոր միջոց էր նշանակել՝ դատարանի կանոնակարգի 39-րդ կանոնի համաձայն և Ադրբեջանին և Հայաստանին կոչ էր արել ձեռնպահ մնալ որևէ միջոցառումներից, մասնավորապես՝ ռազմական գործողություններից, որոնք կարող են հանգեցնել քաղաքացիական բնակչության իրավունքների ոտնահարման, այդ թվում ՝ նրանց կյանքը և առողջությունը ռիսկի տակ դնելուն, և կատարել Կոնվենցիայով ստանձնած իրենց պարտավորությունները»,-ասված է հաղորդագրությունում:
Նշվում է, որ 2021-ի մարտի 9-ին Պալատը, որին հանձնարարվել էր փոխադարձ հայցերի քննարկումը, կողմերին տեղեկացրել է, որ գործը կքննի Մեծ պալատը:
