Կարգավորվում է աճուրդների անցկացման խնդիրը

Այսօր գործադիրը հավանության արժանացրեց «ՀՀ հողային օրենսգրքում լրացումներ և փոփոխություններ կատարելու մասին» օրենքի նախագիծը:
Նախաձեռնությունը ուղղված է պետական և համայնքային հողերի կառավարման ոլորտը կարգավորող իրավական ակտերի պարզեցման, դրանցով սահմանված տնտեսապես ոչ արդյունավետ և աննպատակահարմար մեխանիզմների կրճատմանն ու վերանայմանը:
Ինչպես նաև, ներկայումս, հողամասերն անհատույց օգտագործման իրավունքով տրամադրելիս՝ եթե պահանջվող հողամասը գտնվում է այլ անձի օգտագործման ներքո, պահանջվում է հողօգտագործողի գրավոր համաձայնությունը, նրա չհամաձայնվելու դեպքում նրա իրավունքները այդ հողամասի նկատմամբ դադարում են:
Նախագծով առաջարկվում է Օրինսգիրքը լրացնել հողամասը այլ հողօգտագործողից վերցնելու պարագայում նրան առնվազն մեկ ամիս առաջ ծանուցելու մասին դրույթով, քանի որ տեղի է ունենում գործող հողօգտագործողի իրավունքների խախտում, ինչպես նաև կրճատվում է համայնքի ղեկավարի կողմից հողերը լիազոր մարմնի հայտի ստացման պահից օգտագործման տալու չհիմնավորված մեկամսյա ժամկետը՝ մինչև 15 աշխատանքային օր:
Բացի այդ, գործող օրենսդրությամբ աճուրդի չկայացման հիմք է հանդիսանում նաև մեկ հայտ ներկայացված լինելու փաստը, ինչը հակասում է «Հրապարակային սակարկությունների մասին» ՀՀ օրենքին: Նախագծով առաջարկվում է սահմանել, որ մեկ հայտով աճուրդը կայացած է համարվում՝ կրճատելու համար հող տրամադրողի և գնորդի կողմից չհիմնավորված ծախսերը և ժամանակը :
Ինչպես նաև, առաջարկվում է սահմանել, որ մրցույթում լավագույն պայմանները ճանաչելու և մասնակիցների կողմից մրցութային պայմանների բավարարման աստիճանը գնահատելու նպատակով մրցութային հանձնաժողովը սահմանում է մրցութային պայմանների կշռային գործակցով գնահատման մեթոդ՝ ապահովելու գնահատման գործընթացի օբյեկտիվ չափանիշներ:
Օրենսդրական նախաձեռնությունը առաջարկում է առավել կարգավորված և հստակեցված գործընթացներ, որոնց արդյունքում կպաշտպանվեն քաղաքացիների և տնտեսվարողների իրավունքները, և զերծ կպահի նրանց ավելորդ ժամանակի և միջոցների կորստից:
