2021թ. մայիսի 30-ին` ժամը 21:30-ի սահմաններում, Արմավիրի մարզի Արաքս համայնքում մի խումբ անձանց միջև կենցաղային հարցերի պատճառով վիճաբանություն և ծեծկռտուք է տեղի ունեցել, որի ժամանակ մեկ անձ ստացել է մարմնական վնասվածք, հնչել են կրակոցներ:

Այս մասին տեղեկանում ենք Քննչական կոմիտեից:

Դեպքի առթիվ հարուցվել է քրեական գործ՝ խուլիգանության և ապօրինի կերպով զենք, ձեռք բերելու, պահելու, կրելու հատկանիշներով, որի նախաքննությունը կատարվում է ՀՀ քննչական կոմիտեի Արմավիրի մարզային քննչական վարչության Վաղարշապատի քննչական բաժնում:

Նախաքննության ընթացքում իրականացված անհետաձգելի քննչական և դատավարական այլ գործողությունների, ինչպես նաև՝ ՀՀ ոստիկանության աշխատակիցների հետ համատեղ ձեռնարկված միջոցառումների արդյունքում պարզվել են դեպքի մի շարք հանգամանքներ՝ միջադեպին մասնակից անձանց, այդ թվում՝ ինքնաձիգից կրակոց արձակած անձի ինքնությունը:

Քրեական գործով էական նշանակություն ունեցող հանգամանքներ պարզելու նպատակով նշանակվել է դատաբժշկական փորձաքննություն, հարցաքննվել են մի շարք անձինք, այդ թվում՝ միջադեպի մասնակիցները, ովքեր տվել են ինքնախոստովանական ցուցմունքներ: Երեք անձի նկատմամբ որպես խափանման միջոց է ընտրվել ստորագրություն՝ չհեռանալու մասին:

Ձեռնարկվում են միջոցառումներ՝ քննությամբ ստացված տվյալները, ցուցմունքներում մատնանշված հանգամանքներն ստուգելու, հանցագործության գործիք հանդիսացող ինքնաձիգը հայտնաբերելու ուղղությամբ. ձեռք բերված ապացույցների հիման վրա՝ միջադեպին մասնակից անձանց գործողություններին կտրվի համապատասխան քրեաիրավական գնահատական։

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
