«Պատերազմի ընթացքում վարչապետի պաշտոնը զբաղեցնող Նիկոլ Փաշինյանն ուղղակի դիտավորությամբ կատարել է արարքներ, որով օգնել է Ադրբեջանի Հանրապետությանը, որպեսզի վերջինիս կողմից Արցախի Հանրապետության դեմ իրականացված թշնամական գործունեության արդյունքներով Ադրբեջանի վերահսկողության ներքո վերադառնան հայկական զինված ուժերի կողմից նախկինում ազատագրված, Արցախի տարածքային ամբողջականության մաս կազմած տարածքները, այդ թվում՝ Հադրութի շրջանը եւ Շուշի քաղաքը»:

Նման եզրահանգման է եկել դատախազի ավելի քան երկու տասնամյակի փորձ ունեցող, Հոկտեմբերի 27-ի գործով մեղադրող դատախազ, այժմ փաստաբանությամբ զբաղվող Հակոբ Մարտիրոսյանը։ Նա պատերազմից հետո արդեն մի քանի ամիս զբաղված է եղել մինչպատերազմական եւ պատերազմական իրադարձություններն ուսումնասիրելով եւ դրանց հիման վրա եզրակացրել է, որ Փաշինյանը կատարել է առերեւույթ, առանձնապես ծանր հանցագործություն՝ պետական դավաճանություն, եւ նրա նկատմամբ պետք է գործ հարուցվի Քրեական օրենսգրքի 299-րդ եւ իրավասությունների գերազանցման հոդվածներով։ Այդ ուսումնասիրությունները՝ որպես հանցագործության մասին հաղորդում ՀՀ գլխավոր դատախազին ուղարկելու առիթը դարձել են Փաշինյանի՝ օրերս հնչեցրած սպառնալիքները՝ քաղաքացիական պատերազմ, վենդետա, ինչպես Մարտիրոսյանն  է ասում՝ արյան վրեժ լուծելու մասին։ Նա՝ որպես փորձառու դատախազ, կարծում է, որ Գլխավոր դատախազությունն իր դիմումին ընթացք կտա, որովհետեւ փաստարկներն ամուր իրավական հենքի վրա են կառուցված։
