Մեր գերիների նկատմամբ ադրբեջանական իշխանությունների կազմակերպած դատավարություններն արհեստական են, արտաքին աշխարհի համար նախատեսված շղարշ են միայն նրա համար, որ ունենան գերիներին ազատ չարձակելու «արդարացում», իսկ այդ ընթացքում հասցնեն որքան հնարավոր է շատ ռազմական-քաղաքական օգուտներ ստանալ: Այս մասին գրառում է կատարել ՀՀ ՄԻՊ-ը։

Ադրբեջանական իշխանությունները գերիների անհապաղ վերադարձի հումանիտար պարտադիր պահանջն ի սկզբանե են արհամարհել:

Փոխարենը` զբաղվել են քաղաքական սակարկություններով ու մարդկանց առևտրով. օրինակ՝ տարածքային կամ ինչ-որ ականապատ քարտեզների դիմաց մաս-մաս պատանդ պահվող մարդկանց փոխանակելու հարցերում:

Մարդու իրավունքների պաշտպանը հրապարակել է այս փաստը հաստատող անհերքելի ապացույց՝ Ադրբեջանի նախագահի և Թուրքիայի առաջին տիկնոջ միջև խոսակցության տեսանյութը:

Դատավարությունների հիմքում դրվում են գերիների «խոստովանական ցուցմունքները» ու դա արվում է այն պայմաններում, երբ ամենօրյա իրական սպառնալիքի տակ է գերիների կյանքը, կոպիտ խախտված է անմարդկային վերաբերմունքի բացարձակ արգելքը։

Շարունակվում է պետական մակարդակով թշնամանքի հրահումը: Միջազգային իրավունքի կոպիտ խախտումներով այս պրակտիկան հիմնավորված է Պաշտպանի հատուկ զեկույցում: Նման պայմաններում ավելորդ է խոսել արդար դատաքննության կամ որևէ այլ իրավունքի մասին:

Հատկապես դատապարտելի է ադրբեջանական իշխանությունների կողմից դատավարությունների ցուցադրական լուսաբանումը մարդու արժանապատվությունը ոտնահարող եղանակներով: Այդ լուսաբանումներից հետո ամեն անգամ Ադրբեջանում բարձրանում են գերիներին տանջելու, սպանելու կոչեր, հրահրվում է ատելություն (ապացույցները փաստագրված են):

Մարդու իրավունքների պաշտպանին գերիների և անհայտ կորածների ընտանիքներից շարունակաբար ուղղվող բողոքներն ու ահազանգերն ակնհայտ վկայում են, որ դատավարությունները լրացուցիչ հոգեկան տառապանքներ են պատճառում, ավելի ցավալի են դարձնում մարդկանց ապրումները:

Վերջապես, չպետք է մոռանալ այն հիմնարար փաստը, որ գերեվարումները տեղի են ունեցել արցախյան հակամարտության շրջանակներում, որը մինչ այժմ չի ավարտվել:

Այսինքն` Ադրբեջանում պահվող բոլոր զինծառայողներն ու քաղաքացիական անձինք կարգավիճակով գերի են ի սկզբանե:

Հետևաբար, ցանկացած դատավարություն ի սկզբանե կեղծիք է, միջազգային իրավունքի կոպիտ խախտմամբ ստեղծված շղարշ` դրանք ինչ-որ ձև լեգիտինացնելու երանելի ցանկությամբ, իսկ գերիներին կալանքի տակ պահելը` արգելված պատիժ:

Այս վիճակը կոպիտ խախտում է մարդու իրավունքների միջազգային պահանջները, այդ թվում` Ժնևի 1949թ. երրորդ կոնվենցիան:

Այս ամենը պետք է նկատի ունենան բոլորը, այդ թվում` հայաստանյան մասնագիտական շրջանակները:

Մարդու իրավունքների պաշտպանը նորից է հրավիրում միջազգային հանրության ուշադրությունը այս փաստերին և ադրբեջանական իշխանությունների պահվածքին, որ կոպտերեն ոտնահարում է միջազգային իրավունքի հիմքերը, խաթարում է տասնյակ տարիներով մշակված միջազգային մարդասիրական իրավունքի համակարգը:

Այս հայտարարությունը անհրաժեշտ ապացույցներով ևս կուղարկվի բոլոր կառույցներին: Բոլոր գերիները պետք է անհապաղ ազատ արձակվեն ու վերադարձվեն հայրենիք՝ առանց որևէ նախապայմանի:
