ՀՀ քննչական կոմիտեի հատկապես կարևոր գործերի քննության գլխավոր վարչությունում ավարտվել է Կոտայքի մարզի բնակչուհու կողմից, բժշկական կենտրոնի հերթապահ մանկաբույժի կազմակերպմամբ, շահադիտական շարժառիթով, ստանձնողի խնամքին հանձնելու նպատակով իր նորածին երեխայի վաճառքի, խնամքը ստանձնելու նպատակով երեխայի առքի, ինչպես նաև՝ քաղաքացիական կացության գրանցման մարմիններին սուտ տեղեկություններ հայտնելու դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը:

Նախաքննությամբ ձեռք բերված ապացույցներով պարզվել և հիմնավորվել է, որ 2017 թ. մարտի 25-ին Կոտայքի մարզի բնակչուհին ծննդաբերել է արական սեռի երեխա և չունենալով երեխայի կարիքները հոգալու համար բավարար միջոցներ՝ որոշել է կամ փոքրիկին թողնել ծննդատանը, կամ հանձնել մանկատուն:

Բժշկական կենտրոնի նախկին հերթապահ բժիշկ-մանկաբույժը, այս մասին տեղեկանալով, որոշել է կազմակերպել փոքրիկի խնամքի ստանձնումը իր մորաքրոջ աղջկա կողմից, ինչի շուրջ պայմանավորվածություն է ձեռք բերել ծննդկանի հետ:

Ստանալով ծննդկանի համաձայնությունը՝ որոշակի փոխհատուցում ստանալու պայմանով երեխային ստանձնողի խնամքին հանձնելու շուրջ, հերթապահ բժիշկ-մանկաբույժը կազմակերպել է երեխայի մոր և  իր բարեկամուհու ու նրա ամուսնու հանդիպումը բժշկական կենտրոնում, որի ընթացքում ձեռք է բերվել պայմանավորվածություն՝ ամուսինների կողմից նորածին երեխայի խնամքը ստանձնելու նպատակով, երեխայի մորը որոշակի փոխհատուցում տալու պայմանով, ուղղակի դիտավորությամբ երեխայի առք, իսկ մոր կողմից՝ երեխայի վաճառք կատարելու շուրջ, որից հետո Քաղաքացիական կացության ակտերի գրանցման գործակալության Արմավիրի տարածքային ստորաբաժանումից երեխայի ծննդյան վկայականն ստանալուց հետո ամուսինները մանկաբույժի միջոցով ծննդկանին են փոխանցել 20.000 ՀՀ դրամ գումար և ավելի քան  20.000 ՀՀ դրամ արժողության քաղցրավենիք:

Այնուհետև, երեխայի հայրությունը ճանաչելու նպատակով, բժշկի բարեկամուհու ամուսինը և նորածնի կենսաբանական մայրը միասին գնացել են ՔԿԱԳ Աբովյանի տարածքային ստորաբաժանում, որտեղ նախազգուշացվելով ՔԿԱԳ մարմիններին սուտ տեղեկություններ հաղորդելու համար պատասխանատվության մասին, երեխայի կենսաբանական հայրը հանդիսանալու վերաբերյալ ակնհայտ սուտ տեղեկություններ հաղորդելու դիտավորությամբ, ներկայացրել են «ծնողների համատեղ, միակողմանի կամ դատարանի վճռի հիման վրա երեխայի հայրության որոշման մասին» դիմում և ստացել հայրության որոշման մասին պետական վկայական:

Մինչդատական վարույթում ձեռք բերված բավարար ապացույցների համակցությամբ՝ նորածնի մորը մեղադրանք է առաջադրվել՝ ՀՀ քրեական օրենսգրքի 168-րդ հոդվածի 1-ին մասով և 169.1-րդ հոդվածով, երեխայի հայրությունն ստանձնած տղամարդուն՝ 168-րդ հոդվածի 1-ին մասով և 169.1-րդ հոդվածով, վերջինիս կնոջը՝ 168-րդ հոդվածի 1-ին մասով, իսկ մանկաբույժին՝ 38-168-րդ հոդվածի 1-ին մասով: Քրեական գործով բոլոր մեղադրյալների նկատմամբ որպես խափանման միջոց ընտրվել է ստորագրություն՝ չհեռանալու մասին:

Նախաքննությունն ավարտվել է, և քրեական գործը, մեղադրական եզրակացությունը հաստատելու և դատարան ուղարկելու միջնորդությամբ, ուղարկվել է դատախազական հսկողություն և դատավարական ղեկավարում իրականացնող դատախազին:
