«Փաստ» օրաթերթը գրում է
Հուլիսի 1-ից Հայաստանում գործում է բջջային հեռախոսով ճանապարհային երթևեկության կանոնների խախտում արձանագրելու կարգը: Սակայն activesociety.am վեբ կայքում հնարավոր է գրանցվել միայն eID կամ MOBILEID համակարգերի միջոցով։ Քաղաքացիները դժգոհում են, որ էլեկտրոնային նույնականացման քարտ կարդալու սարք, մեղմ ասած, ոչ բոլոր քաղաքացիներն ունեն: Երկրորդ դեպքում՝ պահանջվում է բջջային նույնականացման քարտ, որը տրամադրող կազմակերպությունը սպասարկում է միայն «Բիլայն» ընկերության համարներ, այն էլ՝ հատուկ քարտերով, այսինքն՝ քաղաքացին պետք է պարտադիր նոր քարտ գնի: Ստացվում է, որ քաղաքացիները, որոնք ցանկանում են արձանագրել իրավախախտումներ, հայտնվում են անհավասար պայմաններում, սահմանափակվում են օրենքից օգտվելու նրանց իրավունքները: Այս հարցով դիմել էինք ՀՀ ոստիկանություն, որտեղից ստացել ենք պատասխան, որ նման կարգավորմամբ որևէ խտրական մոտեցում չի դրվել:
«Նպատակ է հետապնդվել, որպեսզի բացառվի երրորդ անձի կողմից որևէ մեկ այլ քաղաքացու անձնական տվյալներով բջջային հավելվածի օգտատեր դառնալը, քանի որ հակառակի դպքում՝ օրինակ ֆինանսավարկային, ապահովագրական, ոտիկանության և այլ կազմակերպությունների և պետական մարմինների աշխատակիցները, ունենալով հասանելիություն որևէ անձի անձնական այս կամ այն (հարցմամբ որպես օրինակ նշված տվյալներին) տվյալներին, կկարողանային այլ անձի անունից գրանցվել որպես բջջային հավելվածի օգտատեր»,- ասված է պատասխանում։
Մեկ այլ հարց վերաբերում է այն հանգամանքին, որ լուսանկարահանելիս, տեսանկարահանելիս երթևեկության մեջ գտնվող վարորդն իր հեռախոսով որոշակի գործողություններ է կատարելու: Արդյո՞ք սա ինքնին իրավախախտում չէ: «Տրանսպորտային միջոցների վարորդների (բացառությամբ ծառայողական առաջադրանքներ կատարող, օպերատիվ ծառայությունների տրանսպորտային միջոցների վարորդների) կողմից թեկուզ մեկ ձեռքի օգտագործմամբ ընթացքի ժամանակ ռադիոկապից և (կամ) հեռախոսակապից օգտվելն ինքնին իրավախախտում է և անընդունելի որևէ ենթադրյալ իրավախախտում արձանագրելու համար թույլ տալ մեկ այլ իրավախախտում»,- պատասխանել են ոստիկանությունից։
Այսինքն, մեքենայի ընթացքի մեջ գտնվող վարորդը չի կարող արձանագրել խախտում: Մնում է հասկանալ, թե այդ դեպքում ինչպես է դա իրականացվելու, ում է վերաբերում այս օրենքը, ինչպես է գործելու և ինչի համար է գրվել ընդհանրապես:
