Ընտրությունների արդյունքները վիճարկող, ՍԴ ներկայացված դիմումներն ենթակա են մերժման․ ԿԸՀ նախագահ

Կենտրոնական ընտրական հանձնաժողովը համակարծիք չէ 4 քաղաքական ուժերի կողմից ընտրախախտումների վերաբերյալ ներկայացված իրավական հիմնավորումների ու պնդումների հետ և գտնում է, որ դիմումների պահանջները ենթակա են մերժման։ Սահմանադրական դատարանում արտահերթ խորհրդարանական ընտրությունների արդյունքները վիճարկող դիմումների քննության ժամանակ այս մասին ասաց ԿԸՀ նախագահ Տիգրան Մուկուչյանը։
«Առաջին հերթին ընտրությունների արդյունքները անվավեր ճանաչելու համար պետք է պարզել, թե արդյոք ընտրության կազմակերպման ու անցկացման, ինչպես նաև քվեարկությունների արդյունքների ամփոփման արդյունքում տեղի ունեցել Ընտրական օրենսգրքի պահանջների խախտումներ։ Երկրորդ՝ այդ արձանագրված խախտումները պետք է կասկածի տակ դնեն քվեարկության արձանագրված արդյունքները։ Երրորդ՝ խախտումների բնույթը պետք է լինի այնպիսին, որ ընտրությունների արդյունքների ամփոփման կամ բողոքի քննարկման ժամանակ արդեն հնարավոր չէ ստույգ որոշել քվեարկության մասնակիցների կամարտահայտության իրական արդյունքը։ Ընտրության արդյունքները անվավեր ճանաչելու համար անհրաժեշտ է, որ խախտումների հետևանքները կրեն անդառնալի բնույթ, պետք է կորցված լինի քվեարկության մասնակիցների կամարտահայտությունը ստույգ պարզելու հնարավորությունը։
Հետևաբար, ընտրության արդյունքները անվավեր ճանաչելն իրենից ներկայացնում է բավականին լուրջ քաղաքական և իրավական զենք, որը պետք է օգտագործվի միայն բացառիկ դեպքերում»,- ընդգծեց Մուկուչյանը։
Ըստ ԿԸՀ նախագահի՝ ընտրության արդյունքներն անվավեր ճանաչելիս պետք է դրվի քաղաքացիների ընտրություններին մասնակցելու իրավունքի առաջնայնությունը։
«Հատկապես ընտրության արդյունքներում է նյութականացվում քվեարկության մասնակիցների կամարտահայտությունը։ Այդ իսկ պատճառով ընտրության արդյունքների պաշտպան երաշխիքների ստեղծման հարցերում կարևորվում է արձանագրված արդյունքների վավերականության կանխավարկածը։ Եթե գործնականում այդ սկզբունքը չի պահպանվում ընտրական հանձնաժողովների կողմից, ապա անխուսափելիորեն ձևավորվում են մեխանիզմներ, որոնք թույլ են տալիս նենգափոխել ընտրության արդյունքներն՝ ի հեճուկս ընտրության մասնակիցների կամարտահայտությանը»,- եզրափակեց Մուկուչյանը։
