Հայաստան վերադարձած ռազմագերիները հարցաքննվել են. ի՞նչ են ուզում պարզել իրավապահները
SOCIETY2020թ. Արցախյան պատերազմի առնչությամբ մինչ օրս որևէ քրեական գործ չի հարուցվել կամովին գերի հանձնվելու փաստի կապակցությամբ։ Այս մասին NEWS.am–ը տեղեկացել է՝ ոստիկանություն ուղարկված գրավոր հարցմանն ի պատասխան և քննչական կոմիտեից ստացված տվյալներից։
Քննչական կոմիտեից տեղեկացրել են, որ Ադրբեջանից հայրենադարձված բոլոր ռազմագերիների և գերեվարված անձանց մասնակցությամբ իրականացվել և իրականացվում են մեծածավալ քննչական (այդ թվում նաև՝ հարցաքննություններ) և այլ դատավարական գործողություններ։
«Վարույթն իրականացնող մարմնի կողմից քննություն է իրականացվում զինծառայողների, պահեստազորում ընդգրկված ծառայողների և կամավորների գերեվարվելու հանգամանքների պարզման ուղղությամբ։ Ստացված տվյալներն օպերատիվ կերպով փոխանցվում են իրավասու պետական մարմիններին, ինչպես նաև միջազգային կառույցներին»,– կայքին հայտնել է ՔԿ քրեագիտական գլխավոր վարչության քրեագիտական վարչության պետ Ռաֆայել Վարդանյանը։
Նշենք, որ քրեական պատասխանատվություն է նախատեսված զինվորական ծառայության կարգի դեմ ուղղված հանցագործությունների՝ մասնավորապես քրեական օրենսգրքի 381–րդ և 382–րդ հոդվածների համար։ Օրինակ կամովին գերի հանձնվելը (ՔՕ 381–րդ հոդված) պատժվում է ազատազրկմամբ՝ ութից տասնհինգ տարի ժամկետով: Իսկ 382–րդ հոդվածի 3–րդ մասը, որը սահմանում է գերության մեջ գտնվող զինծառայողի կողմից շահադիտական դրդումներով կամ իր նկատմամբ հակառակորդի ներողամիտ վերաբերմունքն ապահովելու նպատակով այնպիսի գործողություններ կատարելը, որոնք ուղղված են մյուս ռազմագերիների դեմ՝ պատժվում է ազատազրկմամբ՝ առավելագույնը երկու տարի ժամկետով:
