BLOGՄԻՊ Արման Թաթոյանը Ֆեյսբուքի իր էջում գրել է. «Մեր իրավապահ համակարգի հիմնարար խնդիրներից է շարունակում մնալ պրակտիկան, երբ մարդուն զրկում են ազատությունից ու հետո նոր սկսում հավաքել ապացույցներ կամ որոնել հիմքեր: Ցավոք, այս պրակտիկան այդպես էլ չվերացավ:
Մեր այցերն ու բողոքներն են արձանագրել կոնկրետ դեպքեր, երբ մարդուն ազատությունից զրկում են (առավել հաճախ՝ բերման ենթարկելը կամ ձերբակալելը), դրանից հետո նոր սկսում են որոշել վարույթը պետք է լինի վարչական իրավախախտման, թե քրեական:
Ընդ որում, այս իրավիճակներում, երբ, օրինակ, բերման ենթարկվածը կամ ձերբակալվածն ինքը փորձում է հետաքրքրվել` ինչի՞ համար է զրկվել ազատությունից կամ իր նկատմամբ վարույթը լինելու է վարչական, թե քրեական, որպես կանոն, ստանում է պատասխան, որ դեռ պարզ չէ ու երբ կորոշվի, այդ ժամանակ էլ կասեն
կամ ինքը կիմանա, երբ քննիչը կամ դատախազը որոշեն: Էլ չասենք, որ փաստաբաններն են անգամ դժվարությունով պարզում:
Նշվածների մեջ առավել շատ են այն դեպքերը, երբ մարդն ազատությունից զրկվում է` ասենք, բերման է ենթարկվում, բայց իրավապահ մարմնի բերման ենթարկող աշխատակիցն ինքը չգիտի կոնկրետ ինչի արարքի համար է ազատությունից զրկում մարդուն: Այս դեպքերում առավել վատն էլ այն դեպքերն են, երբ, օրինակ, Ոստիկանության բաժնում են որոշում, թե ինչ նկարագրություն տան արարքին կամ ինչպես ներկայացնեն բերման ենթարկելու հանգամանքները ու այն էլ դա անում է այն ծառայողը, ով չի էլ մասնակցել բերման ենթարկելու պրոցեսին:
Իրականում, ոչ թե պետք է մարդուն ազատությունից զրկել և նոր հետո որոնել հիմքեր կամ ապացույցներ ու առավել ևս որոշել վարչական է վարույթը, թե քրեական, այլ իրականում անհրաժեշտ է հավաստել հակառակը՝ սկզբում պետք է լինեն հիմքերը կամ ապացույցները և դրանից հետո նոր միայն հնարավոր կլինի քննարկել մարդուն ազատությունից զրկելու, ասենք, բերման ենթարկելու կամ ձերբակալելու հարցերը»:
