ՀՀ քննչական կոմիտեի Տավուշի մարզային քննչական վարչությունում ավարտվել է խուլիգանության դեպքի առթիվ հարուցված քրեական գործի նախաքննությունը:

Մինչդատական վարույթում իրականացված անհրաժեշտ քննչական և այլ դատավարական գործողությունների արդյունքում պարզվել են դեպքի հանգամանքները՝ շարժառիթը, հանցագործություն կատարած երեք անձանց ինքնությունը, անհատականացվել վերջիններիս գործողությունները, որոնց տրվել է քրեաիրավական գնահատական:

Քննությամբ ձեռք բերված ապացույցներով հիմնավորվել է, որ 2020թ. հունիսի 27-ին՝ ժամը 22:00-ի սահմաններում, աննշան հարցի կապակցությամբ վիճաբանություն է տեղի ունեցել Իջևանի երեք բնակիչների և Աչաջուր համայնքում գտնվող սրճարանի սեփականատիրոջ միջև, որի ընթացքում, գտնվելով ոչ սթափ վիճակում, հասարակական կարգը կոպիտ կերպով խախտելու դիտավորությամբ, ինքնահաստատման և հասարակության,  սրճարանի սեփականատիրոջ, աշխատակիցների և հաճախորդների հանդեպ երևակայական գերազանցությունն արտահայտելու հանդուգն ձգտումով, գյուղի բնակիչների ներկայությամբ, վիճաբանել են սրճարանի սեփականատիրոջ հետ, բռնություն գործադրել վերջինիս նկատմամբ:

Ըստ քրեական գործի նյութերի՝ վիճաբանության ժամանակ, հիշյալ անձանցից մեկը քաշքշել և ձեռքով հարվածել է սրճարանի սեփականատիրոջը, նրան վրաերթի ենթարկելու նպատակով, ընկերների հետ միասին, ավտոմեքենան վարել նրա ուղղությամբ, ինչից խույս տալու համար վերջինս մտել է մոտակայքում գտնվող խանութ:

Այդ ընթացքում, գիտակցելով, որ իրենց գործողություններով խաթարում են գյուղի բնակիչների բնականոն անդորրը, Իջևանի հիշյալ բնակիչները շարունակել են սպառնալ աչաջուրցի տղամարդուն՝ սեռական բնույթի հայհոյանքներ հնչեցնելով, իսկ նրանցից մեկը սրճարանից վերցրած գարեջրի ապակյա շիշը նետել է նրա ուղղությամբ, որը, սակայն, նրան չի դիպել:

Չգոհանալով արվածով՝ մեքենայի բեռնախցիկից վերցրել են մեքենայի ամբարձիչը, մահակ և մեքենայի անիվների բանալին /կլյուչը/ և դրանք թափահարելով քայլել են դեպի հավաքվածները, բռնության սպառնալիքներ տալով ներկաներին և կոպիտ կերպով խախտելով հասարակական կարգը՝ խաթարել են ինչպես սրճարանի, այնպես էլ՝ խանութի բնականոն աշխատանքը, բացահայտ անհարգալից վերաբերմունք դրսևորել նշված սրճարանի և խանութի հաճախորդների, աշխատակիցների ու բազմաթիվ գյուղացիների նկատմամբ՝ նրանց մոտ ստեղծելով անհանգստության, զայրույթի և վախի մթնոլորտ։

Ձեռք բերված բավարար ապացույցների հիման վրա՝ Իջևանի բնակիչներից մեկին մեղադրանք է առաջադրվել ՀՀ քրեական օրենսգրքի 258-րդ հոդվածի 4-րդ մասով, իսկ մյուս երկուսին՝ 258-րդ հոդվածի 3-րդ մասի 1-ին կետով:

Մեղադրյալներից երկուսի նկատմամբ որպես խափանման միջոց ընտրվել է կալանավորումը, իսկ մեկի նկատմամբ՝ ստորագրություն՝ չհեռանալու մասին:

Նախաքննությունն ավարտվել է, և քրեական գործը, մեղադրական եզրակացությունը հաստատելու և դատարան ուղարկելու միջնորդությամբ, ուղարկվել է քրեական գործի նկատմամբ հսկողություն իրականացնող դատախազին:

Ծանուցում. Ենթադրյալ հանցանքի մեջ կասկածվողը կամ մեղադրվողը համարվում է անմեղ, քանի դեռ նրա մեղավորությունն ապացուցված չէ ՀՀ քրեական դատավարության օրենսգրքով սահմանված կարգով` դատարանի` օրինական ուժի մեջ մտած դատավճռով:
