Գործադիրն առաջարկում է պատերազմի ժամանակ զինծառայության կարգի դեմ հանցանք գործած անձանց նկատմամբ համաներում հայտարարել
SOCIETYԻրավական ակտերի նախագծերի հրապարակման միասնական կայքում շրջանառության մեջ է դրվել Արդարադատության նախարարության կողմից ներկայացված «Համաներում հայտարարելու մասին» օրենքի նախագիծը:
Դրանով առաջարկվում է համաներում հայտարարել 2020 թվականի սեպտեմբերի 26-ը ներառյալ ոչ մեծ և միջին ծանրության հանցանք կատարելու մեջ կասկածվող, մեղադրվող կամ այդ հանցանքը կատարելու համար դատապարտված այն անձանց վրա, որոնք 2020 թվականի սեպտեմբերի 27-ից մինչև նոյեմբերի 9-ը ընկած ժամանակահատվածում մասնակցել են արցախյան 44-օրյա պատերազմին։
Առաջարկվում է համաներում կիրառել նաև 44-օրյա պատերազմին մասնակցած այն զինծառայող անձանց նկատմամբ, որոնք կասկածվում, մեղադրվում կամ դատապարտվել են ռազմական դրության ժամանակահատվածում՝ 2020թ․ սեպտեմբերի 27-ից մինչև 2021 թ․ մարտի 24-ը ՀՀ քրեական օրենսգրքի 32-րդ գլխով նախատեսված զինվորական ծառայության կարգի դեմ ուղղված հանցանք կատարելու համար։
Նախատեսվում է նաև, որ օրենքի նախագծի ընդունման դեպքում համաներումը կկիրառվի նաև մինչև այս օրենքն ուժի մեջ մտնելը հետախուզման մեջ գտնվող այն անձանց նկատմամբ, որոնք մինչև 2022 թվականի փետրվարի 1-ը ներառյալ անձամբ կամովին կներկայանան քրեական հետապնդման մարմիններ, իսկ եթե գործը դատարանի վարույթում է` դատարան։
Կառավարությունը հիմնավորում է, որ նման քայլի գնալով գնահատվում է ռազմական գործողությունների ընթացքում զինված ուժերի կողքին կանգնելու քաղաքացիական պարտքի կատարման վեհ գործին նվիրումը, ինչին ի պատասխան ցուցաբերվում է մարդասիրական մոտեցում զինվորական ծառայության կարգի դեմ ուղղված հանցագործություններ կատարած անձանց նկատմամբ:
