Ապօրինի անտառահատումների դեմ ՀՀ դատախազության որդեգրած կոշտ քրեաիրավական քաղաքականության համատեքստում Լոռու մարզի դատախազությունն առանձնահատուկ հետևողականություն է դրսևորում հատկապես անտառների պահպանության համար պատասխանատու պաշտոնատար կողմից իրենց պարտականությունների չկատարման կամ ոչ պատշաճ կատարման հանցավոր դրսևորումներին պարտադիր իրավական գնահատականներ տալու հարցում: Այս մասին հայտնում է Դատախազությունը:

Մարզի դատախազության դատախազների հսկողության ներքո քննվող   քրեական գործերով կատարված նախաքննության ընթացքում ձեռք բերված բավարար ապացույցների հիման վրա 2021թ. հուլիսի 28-ից մինչ սեպտեմբերի 1-ն ընկած ժամանակահատվածում ընդհանուր թվով 9 պաշտոնատար անձինք հանդիսացող` 6 անտառապետի և 3 անտառապահի ՀՀ քրեական օրենսգրքի 315-րդ հոդվածի 2-րդ մասի հատկանիշներով առաջադրվել են մեղադրանքներ:

Նախաքննությամբ հիմնավորվել է, որ, ի պաշտոնե պարտավոր լինելով իրականացնել կանխարգելիչ միջոցառում­ներ և հսկողություն ապօրինի անտա­ռահատումների ու ՀՀ անտառային օ­րենս­դրության այլ խախ­տում­ների նկատմամբ, ծառայութ­յան նկատմամբ ան­բարե­խիղճ և անփույթ վերաբերմունք դր­սևորելու հետևանքով նրանք պատշաճ չեն կատարել իրենց վրա դրված պարտակա­նութ­­յունները: Մասնավորապես՝ իրենց վերապահված պահաբաժիններում պարբերաբար շրջայցեր չեն իրականացրել, ինչի արդյունքում  արձանագրվել է ապօրինի հատված 1471 տարբեր տեսակի և տրամագծերով ծառեր: Դրանց հետևանքով կենդանական և բուսական աշխարհին պատճառվել է առանձնապես խոշոր չափերի՝ շուրջ 136 մլն ՀՀ դրամի չափով վնաս։

Նշված բոլոր քրեական գործերով նախաքննությունը շարունակվում է, միջոցներ են ձեռնարկվում գործերի լրիվությունը, բազմակողմանիությունը և օբյեկտիվությունը ապահովելու, բնությանը պատճառված վնասը վերականգնելու, ինչպես նաև այլ անձանց հնարավոր առնչությունը պարզելու համար։

Հիշյալ ժամանակահատվածում պաշտոնատար անձի, մասնավորապես «Հայանտառ» ՊՈԱԿ «Ստեփանավանի անտառտնտեսություն» մասնաճյուղի Գյուլագարակի անտառպետության անտառապահի կողմից իր պարտականություններն անփույթ կատարելու պատճառով ապօրինի ծառահատումների վերաբերյալ մեկ քրեական գործ ուղարկվել է դատարան:

Այս տարվա հունիսին տեղեկացվել էր, որ հարուցված քրեական գործերով կատարված նախաքննությամբ ձեռք բերված բավարար տվյալների գնահատմամբ 2021թ. առաջին հինգ ամիսներին ևս ընդհանուր 18 պաշտոնատար անձի՝ «Հայանտառ» ՊՈԱԿ-ի՝ Լոռու մարզի տարբեր անտառային տնտեսությունների անտառապետերի, անտառապահների, ինժեներների առաջադրվել են մեղադրանքներ՝ ՀՀ քրեական օրենսգրքի 315-րդ հոդվածի 2-րդ մասի և 314-րդ հոդվածի 1-ին մասի հատկանիշներով:

Հաշվի առնելով քննությամբ պարզված հանգամաքնները և այն իրողությունը, որ մարզի տարածքի անտառներից ապօրինի  ծառահատումների որոշ դեպքերի կապակցությամբ կատարված քննությամբ հաստատվել է, որ մեծ քանակությամբ ծառահատումները տևական ժամանակ կատարվել են ակներևության պայմաններում,  փայտանյութն անարգել դուրս է բերվել անտառտնտեսության տարածքից, այսինքն նաև ոստիկանության համապատասխան ծառայողների կողմից պատշաճ հսկողություն չի իրականացվել, Լոռու մարզի դատախազը գրություն է հասցեագրել ՀՀ ոստիկանության պետի առաջին տեղակալին՝ կոնկրետ նշելով այն անհրաժեշտ միջոցառումները, որոնք անհրաժեշտ են ձեռնարկել մարզի տարածքում ապօրինի անտառահատումների կանխարգելման, անտառների նկատմամբ հսկողության ուժեղացման նպատակով:
