SOCIETYՀՀ քննչական կոմիտեի հատուկ հանձնարարությունների, կազմակերպական-վերլուծական և քրեագիտական գլխավոր վարչության քրեագիտական վարչությունում քննվող քրեական գործով դեռևս 2021 թվականի մարտի 16-ին Ադրբեջանի Հանրապետության կողմից Արցախի Հանրապետության դեմ սանձազերծված ագրեսիվ պատերազմի և 2020թ. սեպտեմբերի 27-ին հայտարարված ռազմական դրության ժամանակ ԱՀ պաշտպանության բանակի զորամասերից մեկի ուսումնական գումարտակի հրամանատարի պաշտոնը զբաղեցրած սպային մեղադրանք էր առաջադրվել՝ ՀՀ քրեական օրենսգրքի 356-րդ հոդվածի 3-րդ մասով և 380-րդ հոդվածի 1-ին մասով՝ հանրորեն վտանգավոր այն արարքների կատարման համար, որ վերջինս, զբաղեցնելով ԱՀ պաշտպանության բանակի զորամասերից մեկի ուսումնական գումարտակի հրամանատարի պաշտոնը, հանդիսանալով իր ենթակա անձնակազմի պետը, մարտական գործողությունների ընթացքում չի կատարել իր անմիջական պետի հրամանը, ինչպես նաև ինքնակամ լքել է մարտադաշտը՝ առաջացնելով ծանր հետևանքներ: Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանը բավարարել էր վարույթն իրականացնող մարմնի կողմից ներկայացված միջնորդությունը և սպան կալանավորվել էր։ Այս մասին տեղեկացնում է ՔԿ-ն:
2021 թվականի ապրիլի 9-ին ՀՀ վերաքննիչ քրեական դատարանը բեկանել էր մեղադրյալի նկատմամբ կալանավորումը որպես խափանման միջոց կիրառելու մասին Երևան քաղաքի ընդհանուր իրավասության դատարանի որոշումը, և վերջինս ազատվել էր կալանքից:
2021 թվականի սեպտեմբերի 7-ին ՀՀ վճռաբեկ դատարանը բավարարել է նախաքննության նկատմամբ դատավարական ղեկավարում իրականացնող դատախազի ներկայացրած վճռաբեկ բողոքը՝ ուժի մեջ թողնելով առաջին ատյանի ընդհանուր իրավասության դատարանի որոշումը։ Մեղադրյալը կալանավորվել է և տեղափոխվել ՀՀ ԱՆ համապատասխան քրեակատարողական հիմնարկ:
