«Փաստ» օրաթերթը գրում է
Ներկայացնել պատվաստման հավաստագիր կամ էլ 14 օրը մեկ ՊՇՌ թեստ հանձնել, հակառակ դեպքում գործատուն իրավունք կունենա աշխատողին ազատել աշխատանքից: Սա առողջապահության նախարարի հրամանն է, որն ուժի մեջ է մտնելու հոկտեմբերի 1-ից:
Աուդիտորների պալատի խորհրդի անդամ, փաստաբան Սերգեյ Ամիրխանյանը նշում է. «Այն իրավանորմերը, որոնց հղում է կատարել առողջապահության նախարարն այդ ենթաօրենսդրական ակտն ընդունելու համար, իրեն իրավասություն չեն տվել նշված իրավակարգավորումները նախատեսելու: Զուտ մեկ դիտարկում, որով կփորձեմ հիմնավորել իմ դիրքորոշումը:
ՊՇՌ թեստի կամ պատվաստման առկայությունը ոչ այլ ինչ է, քան բժշկական պարտադիր զննություն կամ բժշկական ազդեցություն, այսինքն՝ բժշկական միջամտություն, որը նախատեսված է «Բնակչության բժշկական սպասարկման մասին» օրենքով, որի 25-րդ հոդվածը հստակ սահմանում է, որ բժշկական միջամտությունից օգտվելը մարդու իրավունքն է, ոչ թե պարտականությունը: Նշված է, որ յուրաքանչյուր անձ իրավունք ունի գրավոր հրաժարվել բժշկական միջամտությունից, իսկ դրա մեջ մտնում են նաև կանխարգելման համապատասխան միջոցառումները: Հենց միայն այս իրավակարգավորումն ապացուցում է, որ առողջապահության նախարարն իրավունք չուներ նման հրաման արձակել, քանի որ այն հակասում է իր ընդունածից ավելի բարձր իրավաբանական ուժ ունեցող նորմատիվ իրավական ակտին, որպիսին հանդիսանում է օրենքը»,-«Փաստի» հետ զրույցում ասում է փաստաբանը:
Ճշտող հարցին՝ ի՞նչ անի աշխատողը, երբ գործատուն իրեն ընտրության առջև կանգնեցնի, Ամիրխանյանն արձագանքում է. «ՀՀ օրենսդրությամբ ներկայումս առկա չէ որևէ իրավակարգավորում, որը իրավունք կտար գործատուին վերը նշված պայմանները չապահովելու դեպքում ազատել աշխատողին աշխատանքից: Հետևաբար, եթե առկա է ապօրինի հրաման գործատուի կողմից, աշխատողն իրավունք ունի այն վիճարկել օրենսդրությամբ սահմանված կարգով դատարանում»,-եզրափակում է Սերգեյ Ամիրխանյանը:
