6 համայնքների նախկին և գործող ղեկավարների դիմումների գործով քննությունը հետաձգվեց

Սահմանադրական դատարանը երեկ՝ սեպտեմբերի 14–ին հետաձգել է Հանրապետության վեց համայնքների նախկին և գործող ղեկավարների դիմումների վերաբերյալ միասնական գործի քննությունը, որի շրջանակներում վիճարկվում է գործադիր իշխանության կողմից տեղական ինքնակառավարմանը միջամտող օրենքների դրույթների սահմանադրականությունը։ Այս մասին NEWS.am–ը տեղեկանում է Սահմանադրական դատարանի կայացրած աշխատակարգային որոշումից։ Բարձր դատարանը գործի քննությունը նշանակել է 2021 թվականի հոկտեմբերի 19-ին՝ ժամը 11.00-ին:
Հիշեցնենք՝ Դիլիջանի նախկին համայնքապետ Արմեն Սանթրոսյանը, Թումանյանի նախկին համայնքապետ Լեւոն Զավարյանը, Գեղարքունիքի մարզի Զոլաքար համայնքի նախկին ղեկավար Արման Ղազարյանը, Տաշիր համայնքի գործող ղեկավար Էդգար Արշակյանը, Լոռու մարզի Ալավերդի համայնքի ղեկավար Սասուն Խեչումյանը և Արթիկ համայնքի ղեկավար Մխիթար Վարագյանը Սահմանադրական դատարանում վիճարկում են «Տեղական ինքնակառավարման մասին» ՀՀ օրենքի 27–րդ հոդվածի 2.1 կետի (համայնքի ղեկավարի լիազորությունների ժամկետը լրանալու դեպքում վարչապետի կամ մարզպետի կողմից համայնքի ղեկավարի պաշտոնակատարի նշանակումը) և 2020 թվականի հունիսի 18-ին ընդունված «ՀՀ ընտրական օրենսգիրք Սահմանադրական օրենքում փոփոխություններ ու լրացումներ կատարելու մասին» ՀՀ օրենքի անցումային և եզրափակիչ դրույթների` 34–րդ հոդվածի 2-րդ մասի 2–րդ կետի ( համայնքի ղեկավարի լիազորությունների ժամկետի լրանալու դեպքում համայնքի ղեկավարի ընտրություն չի նշանակվում, իսկ համայնքի ղեկավարի լիազորությունները մինչև ավագանու լիազորությունների ժամկետը լրանալն իրականացնում է համայնքի ղեկավարի պաշտոնակատարը) սահմանադրականությունը։
Այս գործով վերջին դիմումը ՍԴ է ներկայացրել Գեղարքունիքի մարզի Զոլաքար համայնքի ղեկավար Արման Ղազարյանը, որի լիազորությունների ժամկետն ավարտվել էր այս տարվա հուլիսին։ Բարձր դատարանին դիմած համայնքապետերի կարծիքով՝ այս փոփոխություններով գործադիր իշխանությունը միջամտում է տեղական ինքնակառավարմանը, ինչը հակասում է Սահմանադրությանը։
Նշենք, որ միավորված գործով որպես պատասխանող կողմ դատավարությանը ներգրավվել է վիճարկվող օրենքներն ընդունած մարմինը` Ազգային ժողովը։
