Սահմաններ կան, որոնք չի կարելի հատել. առողջապահության նախարար
BLOGԱռողջապահության նախարար Անահիտ Ավանեսյանը հորդորում է զերծ մնալ մարդկանց՝ բժշկական գաղտնիք պարունակող տվյալներ հրապարակելուց:
«Հարգելի քաղաքացիներ, բժշկակական կազմակերպությունների և մամուլի ներկայացուցիչներ նորից ու նորից հորդորում եմ զերծ մնալ մարդկանց՝ բժշկական գաղտնիք պարունակող տվյալներ հրապարակելուց։
Հիշեցնում եմ, որ «Բնակչության բժշկական օգնության և սպասարկման մասին» ՀՀ օրենքով անձի բժշկական գաղտնիք պարունակող տվյալները կարող են փոխանցվել երրորդ անձանց միմիայն նրա համաձայնությամբ անկախ նրանից ինչպես է այդ տեղեկատվությունը հայտնվել ձեր մոտ։
Ի լրումն նշեմ, որ ՀՀ քրեական օրենսգրքի 145-րդ հոդվածը պատասխանատվություն է նախատեսում բժշկական գաղտնիքը փոխանցելու համար:
Մասնավորապես` վկայակոչված հոդվածի 1-ին մասի համաձայն` բժշկական գաղտնիք պարունակող տվյալները, օրենքով նախատեսված անձնական տվյալներ մշակողի կողմից առանց անձի կամ նրա օրինական ներկայացուցչի գրավոր համաձայնության, օրենքով չնախատեսված դեպքերում փոխանցելը պատժվում է տուգանքով՝ նվազագույն աշխատավարձի երկուհարյուրապատիկից հինգհարյուրապատիկի չափով, կամ որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկելով՝ երկուսից չորս տարի ժամկետով, կամ կալանքով՝ մեկից երկու ամիս ժամկետով:
Նույն հոդվածի 2-րդ մասի համաձայն` բժշկական գաղտնիք պարունակող տվյալները, օրենքով նախատեսված անձնական տվյալներ մշակողի կողմից առանց անձի կամ նրա օրինական ներկայացուցչի գրավոր համաձայնության, օրենքով չնախատեսված դեպքերում զանգվածային լրատվության միջոցներով հրապարակելը կամ տեղեկատվական հաղորդակցման ցանցերում տեղադրելը պատժվում է տուգանքով՝ նվազագույն աշխատավարձի չորսհարյուրապատիկից յոթհարյուրապատիկի չափով, կամ որոշակի պաշտոններ զբաղեցնելու կամ որոշակի գործունեությամբ զբաղվելու իրավունքից զրկելով՝ երկուսից հինգ տարի ժամկետով, կամ կալանքով՝ երկուսից երեք ամիս ժամկետով:
