Ազգային ժողովն ընդունեց ճանապարհային խախտումների տուգանքների մեղմացում նախատեսող փաթեթը

Ազգային ժողովն արտահերթ նիստում` 84 կողմ, 7 դեմ ձայների հարաբերակցությամբ ընդունեց «Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքում փոփոխություններ եւ լրացումներ կատարելու մասին» օրենքի նախագիծը՝ կից օրենսդրական փաթեթով: Այն նախատեսում է ճանապարհային խախտումների համար տուգանքների մեղմացում:
ՀՀ արդարադատության նախարար Արփինե Հովհաննիսյանը երկրորդ ընթերցմամբ քննարկման ներկայացնելիս տեղեկացրել է, որ փաթեթը որոշակի փոփոխություններ է կրել եւ առավել հստակեցվել առաջինից երկրորդ ընթերցում ընկած ժամանակահատվածում: «Օրենսդրական փաթեթն անդրադառնում է բազմաթիվ պատգամավորների մտահոգություններին: Մասնավորապես՝ ներկայացված նախագծերի փաթեթի ընդունման դեպքում հնարավորություն կստեղծվի լուծել ճանապարհային երթեւեկության անվտանգության ապահովման բնագավառում առկա արդիական համարվող մի շարք խնդիրներ: Լուծում է տրվում մտում չպարունակող, նվազ նշանակություն ունեցող տուգանքները նախազգուշացմամբ փոխարինելու խնդրին»,-«Արմենպրես»-ի հաղորդմամբ` ասաց նախարարը: Նրա համոզմամբ՝ օրենսդրական փաթեթով դրական լուծումներ են առաջարկվում:
Օրենսդրական փաթեթով առաջարկվում է նաեւ չտուգանել այն դեպքերում, երբ իրավախախտը խախտումը կվերացնի տեղում: Խստացվել է առանց հաշվառման համարանիշի, կեղծված կամ փոխարինված հաշվառման համարանիշով տրանսպորտային միջոցներ վարելու համար նախատեսված տուգանքի չափը, ինչպես նաեւ տրանսպորտային միջոցները ոչ սթափ վիճակում վարելու համար նախատեսված տուգանքները: Բարձրացվում է պատասխանատվությունը ոչ սթափ վիճակում մեքենա վարելու համար, ընդհուպ մինչեւ քրեական պատասխանատվություն: Նախատեսվում է ճանապարհային երթեւեկության կանոնների խախտման համար կաված վարչական ակտերի բողոքարկման եւ վերանայման գործընթացի դյուրացում՝ ներդնելով նաեւ բողոքարկման էլեկտրոնային համակարգ: Ներմուծվել է նաեւ վարչական իրավախախտումների հաշվարկման բալային համակարգ, որը հաշվարկվում է՝ սահմանված նվազագույն աշխատավարձը երկու բալ հաշվարկելու միջոցով: Կանոնակարգվում են ՀՀ-ում չհաշվառված տրանսպորտային միջոցներով կատարված վարչական իրավախախտումների գործերով առանձնահատկությունները: Հստակեցվում են տրանսպորտային միջոցների վարձակալության դեպքում պատասխանատվության ենթակա սուբյեկտը եւ դրա հետեւանքները: Նա խատեսվում է, որ առաջին անգամ չեն տուգանվի վարորդական վկայականը մոռացած, տեխզննման կտրոնը մեքենայի դիմապակուն չփակցրած վարորդները: Վարորդին հնարավորություն և ժամանակ կտրվի դրանք շտկելու: Վկայականը մոռացած վարորդին 24 ժամ ժամանակ կտան այն ներկայացնելու: Ինչ վերաբերում է մգեցված ապակիներին, ապա դրա համար տուգանքը, որը մինչև այս 50 հազար դրամ էր, իջեցվել է` դառնալով 30 հազար:
2014թ. դեկտեմբերին ընդունված օրենքի համաձայն՝ 6-ամսյա ժամկետում քաղաքացիներին հնարավորություն է տրվել, որպեսզի նրանք վարչականիրավախախտումների դեպքում վճարեն միայն մայր գումարը՝ ազատվելով ավելացված տուգանքներից: Կառավարությունն առաջարկում է համաներման ժամկետն այսպահին երկարաձգել եւս 6 < i>ամսով՝ հնարավորություն ընձեռելով նրանց վճարելու միայն մայր գումարը:
