«Փաստ» օրաթերթը գրում է

Քաղաքաշինության կոմիտեն առաջարկում է պարզեցնել վթարային, շահագործման համար ոչ պիտանի շենքերի և շինությունների անձնագրավորման գործընթացը, կյանքի կոչել նմանատիպ շենքերի կազմաքանդման ծրագրային առաջարկները: Նշվում է, որ շենքերի և շինությունների վերաբերյալ ամփոփ տվյալների հավաքագրման և գույքագրման համար արդյունավետ միջոց է դրանց անձնագրավորումը: Մինչդեռ շատ դեպքերում դրանց տեխնիկական փաստաթղթերը պահպանված չեն, շենքերը չունեն անձնագրեր, արդյունքում դրանց կառավարումը, պահպանումը և շահագործումն իրականացնող մարմինները կամ սեփականատերերը չեն տիրապետում անհրաժեշտ տեխնիկական տվյալների:

Հայաստանի տարածքում կառուցված բնակելի, հասարակական և արտադրական շենքերի ու շինությունների գերակշիռ մասը կառուցվել է խորհրդային տարիներին: Դրանց մեծ մասի շահագործման ժամկետները գերազանցել են նորմատիվային սահմանափակումները, ունեն 40-70 և ավելի տարվա վաղեմություն: Ներկայացված նախագծի հիմնավորման մեջ նշվում է, որ մինչ այժմ ՀՀ պետական և համայնքային բյուջեների միջոցների սահմանափակ լինելը կամ ներդրումային համապատասխան ծրագրերի սակավությունը խոչընդոտ է եղել թե՛ անձնագրավորման, թե՛ դրանից բխող գործընթացների նախաձեռնման և իրականացման համար: Նմանատիպ գործընթացների իրագործումը, հատկապես բազմաբնակարան շենքերի, այդ թվում ընդհանուր բաժնային սեփականություն հանդիսացող գույքի մասով, պահանջում է և՛ գույքի սեփականատերերի կողմից համաձայնեցված, և՛ քաղաքական որոշումների միասնական մոտեցումներ՝ ծախսային երկարաժամկետ ծրագրեր:

Նմանատիպ խնդիրներ առկա են նաև գոյություն ունեցող հասարակական և արտադրական շենքերի պարագայում, երբ դրանց մի մասի սեփականատեր են 1-ից ավելի ֆիզիկական կամ իրավաբանական անձինք, իսկ տարիների վաղեմությամբ առկա են նաև սեփականատերերի իրավահաջորդների ճանաչման խնդիրներ, որոնք ևս իրավակարգավորման ենթակա են այլ օրենսդրական և ենթաօրենսդրական փոփոխությունների շրջանակներում: Այսպիսով՝ նախագծով սահմանվել է 3 կարևորագույն մարմին, որոնց միջոցով նախատեսվում է ամբողջ գործընթացի կազմակերպումը և իրագործումը՝ Միջգերատեսչական հանձնաժողով, տարածքային կառավարման (ՀՀ մարզպետարաններ, Երևանի քաղաքապետարան) և տեղական ինքնակառավարման (համայնքներ) մարմիններ:

Առաջարկվում է նախ տեխնիկական վիճակից ելնելով հաստատել բնակելի, հասարակական և արտադրական նշանակության շենքերը կամ շինությունները շահագործման համար ոչ պիտանի (կազմաքանդման ենթակա) ճանաչելու կարգը: Համապատասխան որոշումներն ուժի մեջ մտնելուց հետո մարզպետները 12-ամսյա ժամկետում կառավարության քննարկմանը պետք է ներկայացնեն բնակելի, հասարակական և արտադրական նշանակության շենքերն ու շինությունները շահագործման համար ոչ պիտանի (կազմաքանդման ենթակա) ճանաչելու վերաբերյալ ծրագրային առաջարկներ՝ ըստ միջոցառումների ժամանակացույցի, հետո մինչև տվյալ տարվան հաջորդող յուրաքանչյուր տարվա մարտի 1-ն ամփոփեն և վարչապետի աշխատակազմ ներկայացնեն դրանց՝ շահագործման համար ոչ պիտանի (կազմաքանդման ենթակա) ճանաչելու գործընթացի ապահովման վերաբերյալ տեղեկատվություն:
