Ժնևում ընթացող Միավորված ազգերի կազմակերպության Մարդու իրավունքների խորհրդի 48-րդ նստաշրջանի շրջանակներում Հայաստանը հանդես է եկել համատեղ հայտարարությամբ՝ նվիրված զինված հակամարտությունների ընթացքում միջազգային մարդասիրական իրավունքի և մարդու իրավունքների պաշտպանությանը։ Հայտարարությանը միացել են տասնինը երկրներ ՄԱԿ բոլոր տարածաշրջանային խմբերից։

Հղում անելով hակամարտությունների խաղաղ ճանապարհով լուծման և ուժի սպառնալիքից կամ ուժի կիրառումից զերծ մնալու՝ ՄԱԿ-ի կանոնադրությամբ ամրագրված հիմնարար սկզբունքներին՝ հայտարարությունը խստորեն դատապարտում է զինված հակամարտությունների ժամանակ մարդու իրավունքների և միջազգային մարդասիրական իրավունքի խախտումները և կոչ է անում պետություններին պատասխանատվության ենթարկել նման հանցագործություններ կատարածներին։

Դրանում մասնավորապես նշվում է, որ ուժի ապօրինի կիրառմանը հաճախ նախորդում կամ ուղեկցում են ատելության խոսքը, պատերազմի լայնածավալ քարոզչությունը, քաղաքական առաջնորդների և հանրային գործիչների ռասայական կամ էթնիկ գերակայության մասին հայտարարությունները, որոնք սփռում են թշնամանք և նախապաշարումներ՝ էթնիկ, կրոնական կամ ռասայական խմբերի հանդեպ, կամ պաշտպանում և արդարացնում նրանց հանդեպ բռնության կիրառումը:

Երկրները վերահաստատում են մարդասիրական կազմակերպություններից օգնություն ստանալու զոհերի իրավունքը, ինչպես սահմանված է 1949 թվականի Ժնևի կոնվենցիաներով և միջազգային մարդասիրական իրավունքի այլ համապատասխան գործիքներով, և կոչ են անում ապահովել այս օգնության անվտանգ և պատշաճ հասանելիությունը:

Նրանք շեշտում են, որ ռազմագերիներն ու ձերբակալվածները պետք է արժանանան միջազգային մարդասիրական իրավունքին համապատասխան վերաբերմունքի, պետք է անհապաղ ազատ արձակվեն և հայրենադարձվեն ակտիվ ռազմական գործողությունների ավարտից հետո: Միջազգային մարդասիրական իրավունքն արգելում է պատանդառությունը, ռազմագերիների և ձերբակալված անձանց ձգձգված բանտարկումը՝ նրանց սակարկման առարկա դարձնելու նպատակով։

Համատեղ հայտարարությունը հորդորում է իրականացնել արդյունավետ օրենսդրական, վարչական, դատաիրավական և այլ միջոցառումներ՝ բռնի անհետացման դեպքերի կանխարգելման, դադարեցման և պատժման նպատակով։

Երկրները կոչ են անում ՄԱԿ համապատասխան մարմիններին ավելի ակտիվ դեր ստանձնել մարդու իրավունքների խթանման և պաշտպանության գործում՝ ապահովելով միջազգային մարդասիրական իրավունքի և մարդու իրավունքների լիարժեք հարգանքը զինված հակամարտություններից բխող բոլոր իրավիճակներում՝ համաձայն Միավորված ազգերի կազմակերպության կանոնադրության նպատակների և սկզբունքների:
