Երեկ՝ հոկտեմբերի 13-ին, ոստիկանների կողմից Կուրղինյան 3/15 հասցեից երեխաների ներկայությամբ քաղաքացի Վազգեն Ռաֆայելյանին բռնի ուժով բերման ենթարկելուց հետո նրա 5-ամյա երեխային տեղափոխել են հիվանդանոց։ Այս մասին ԼՈՒՐԵՐ․com-ի հետ զրույցում ասաց Ռաֆալելյանի փաստաբան Հասմիկ Մարտիրոսյանը։

Նրա խոսքով՝ երեխան ցնցումների մեջ է ընկել, որից հետո տեղափոխվել է «Սուրբ Աստվածամայր» բժշկական կենտրոնում․ «Երեխայի վիճակը բժիշկներն ասում էին սթրեսի արդյունք է, ինչը եղել է ոստիկանների գրոհի հետևանքով։ Երեխային ներարկում են արել, դեղեր են նշանակել, դիմել ենք նաև հոգեբանի»,- ասաց Մարտիրոսյանը։

Փաստաբանը պարզաբանեց, թե քաղաքացու ինքնակամ կառուցած կառույցի պատճառով ոստիկանները բիրտ գործողությունների են դիմել. «Այդ կառույցի օրինականացման վերաբերյալ կա հարուցված գործ և կան դատարանի բոլոր որոշումները։ Քանդման որոշումը ևս վիճարկված էր։ Մոտենում են երեկվա կայացված ինչ-որ որոշմամբ և դիմում գործողությունների։ Ես ասում էի, որ մենք օրենքով պաշտպանված ենք և հորդորում էի չիրականացնեն գործողություններ, քանի որ դրա իրավունքը չունեն։ Սակայն, իմ բացատրությունները, որոնք փաստաթղթավորված էին, անուշադրության մատնվեցին։ Ոստիկաններն դիմեցին բիրտ գործողությունների՝ քաշելով, հայհոյելով, գետնին պառկեցնելով ձեռնաշղթաներ հագցրին իմ պաշտպանյալին։ Վայրագության հասնող վարքագծով քանդեցին շինությունը, նույնիսկ երեխաների տնկած ծաղիկներն ու ծառերն էին հանում հողից։ Այս տեսարանը երեխաների աչքի առաջ էր և նրանք վախից փախել էին դաշտերի մեջ, չգիտեմ էլ, թե ինչպես են գտել նրանց»,- պատմեց Մարտիրոսյանը։

Նա նշեց՝ կառույցի քանդման որոշումը վիճարկելու են Վարչական դատարան, իսկ ոստիկանների գործողությունների առնչությամբ հաղորդում են ներկայացրել Հատուկ քննչական ծառայություն. «Դիմել եմ Մարդու իրավունքների պաշտպանի գրասենյակ, ՀՔԾ ներկայացրել եմ հաղորդում, մյուս մասով էլ Վարչական դատարանում կվիճարկվեն նրանց գործողությունները»։

Նշենք, որ երեխայի առողջական վիճակի մասին տեղեկություններ ստանալու նպատակով ԼՈՒՐԵՐ.com-ը կապ էր հաստատել «Սուրբ Աստվածամայր» ԲԿ-ի խոսնակի Գևորգ Դերձյանի հետ։ Նա նշել էր, որ երեխային այսօր էր տեղափոխվել հիվանդանոց շտապօգնության մեքենայով. «5 տարեկան տղա երեխա է եղել, իրեն վատ է զգացել, սրտխառնոց է ունեցել: Մեզ մոտ ստացել է առաջին բուժօգնությունը, դեղեր են նշանակել և դուրս է գրվել»,- հայտնել էր խոսնակը:

Ավելի վաղ, Փաստաբանների պալատի նախկին նախագահ Արա Զոհրաբյանը հրապարակել էր տեսանյութեր, որտեղ երևում էին, թե ինչպես են ոստիկանները ուժ գործադրելով բերման ենթարկում քաղաքացուն, որոնց հրամայվում է նրան «պառկացնել, կոխել ավտոն»:
