Սյունիքի մարզի ընդհանուր իրավասության դատարանը՝ դատավոր Գնել Գասպարյանի նախագահությամբ, բավարարել է պաշտպանների միջնորդությունը և 20 մլն դրամ գրավի դիմաց ազատ արձակել Սիսիանի նախկին համայնքապետ, «Հայաստան» խմբակցության պատգամավոր Արթուր Սարգսյանին։ Այս մասին Tert.am-ին հայտնեց Սարգսյանի փաստաբան Էմին Խաչատրյանը։
«Շատ սպասելի որոշում էր, մինչև լուսադեմ աշխատել ենք դատարանում, դեռ չենք հասցրել դատարանի որոշմանն ամբողջությամբ ծանոթանալ, քանի որ բավականին ծավալուն է։ Գիշերը գրավի կտրոնը ներկայացրել ենք, որից հետո Արթուր Սարգսյանը ազատ է արձակվել»,– ասաց նա։
Էմին Խաչատրյանը նշեց, որ միջնորդության հիմքում դրվել է այն հանգամանքը, որ վերացել է գործին խոչընդոտելու ռիսկայնությունը։
«Ռիսկ չկա, որ ազատության մեջ մնալով՝ Արթուր Սարգսյանը կարող է խոչընդոտել գործի քննությանը, բացի դրանից, միջնորդության հիմքում դրված է նաև այն, որ որոշակի ժամկետներ կան կապված վաղեմության հետ, որոնք մոտենում են ավարտին։ Պրակտիկ իրավաբանության մեջ իրատեսական չէ, որ նման ծավալի գործի քննությունը երեք ամսում ավարտվի։ Դատարանի եզրահանգումներին մանրամասն ծանոթանալուց հետո հետագայում ավելի մանրամասն կանդրադառնանք գործին»,- ասաց Էմին Խաչատրյանը։
Հիշեցնենք, որ արտահերթ խորհրդարանական ընտրություններից հետո Սիսիանի արդեն նախկին քաղաքապետին մեղադրանք է առաջադրվել ՀՀ Քրեական օրենսգրքի 308-րդ հոդվածի երկրորդ մասի (պաշտոնեական լիազորությունները չարաշահելը) և 314-րդ հոդվածի առաջին մաս (պաշտոնատար անձի կողմից շահադիտական նպատակով կամ անձնական այլ դրդումներով կամ խմբային շահերից ելնելով՝ պաշտոնական փաստաթղթերում ակնհայտ կեղծ տեղեկություններ կամ գրառումներ մտցնելը, կեղծում, քերվածք կամ այլ թվական գրառումներ կամ փոփոխություններ կատարելը, ինչպես նաև կեղծ փաստաթղթեր կազմելը կամ հանձնելը) հատկանիշներով:
