ԱԱԾ-ն բացահայտել է, որ ՀՀ պետական եկամուտների կոմիտեի պաշտոնյաները խոշոր չափերի կաշառքներ են ստացել տնտեսվարողներից: Այս թեմայով Past.am կայքը զրուցել է իրավական հարցերով փաստաբան Սերգեյ Ամիրխանյանի հետ։
 
Պարոն Ամիրխանյան, ինչպե՞ս եք մեկնաբանում երևույթն այն համատեքստում, երբ այս իշխանության ներկայացուցիչները ամենաբարձր մակարդակով բազմիցս հայտարարել են, թե Հայաստանում համակարգային կոռուպցիա չկա:
 
- Դուք բավականին ծավալուն և ընդգրկուն հարց եք բարձրացնում հիմա, կարող եմ ասել, որ մեկ կամ երկու դեպքը դա անկախ իշխանություններից, բոլոր դեպքերում էլ պետք է լինի, քանի որ կոռուպցիան ոչ մի երկրում ամբողջությամբ վերացված չի և նման դեպքեր չեն կարող չլինել։ Բայց, մյուս կողմից էլ, եթե մենք դիտարկում ենք այս իշխանությունների հայտարարությունների համատեքստում, ապա կարող եմ ասել, որ մենք բազմիցս ականատես ենք եղել, որ այս իշխանությունները հայտարարում են մեկ բան, բայց պարզվում է, որ իրականությունը լրիվ այլ է։ Այս պահին ես որևէ հիմնավոր փաստ էլ չունեմ համակարգային կոռուպցիայի մասին և իրականում կոռուպցիան ինքը իրենից չի ենթադրում միայն կաշառքի դեպքերը, կոռուպցիան մի փոքր ավելի ընդգրկուն երևույթ է, օրինակ, հովանավորչությունը, ծանոթ բարեկամով գործի ընդունելը և նմանատիպ բոլոր հարցերը կոռուպցիայի ձևեր են։ Եվ եթե մենք դիտարկում ենք կոռուպցիան դասական եղանակով, ապա այդ տեսանկյունից, կարծում եմ, որ մեզ մոտ բան չի փոխվել, եթե նույնիսկ ավելի չի վատացել։
 
Իրավական համակարգի այսօրվա վիճակը ձեզ թո՞ւյլ տալիս է մտածել, որ կունենանք արդար ու թափանցիկ քննություն:
 
- Իրականում դժվար է պատասխանել այդ հարցին, քանի որ անձամբ ես քննչական գործերով քիչ եմ զբաղվում, բայց դատելով իմ գործընկերների և նման գործերին մոտ կանգնած բոլոր մարդկանց կարծիքներից և ականատես լինելով որոշակի դեպքերի, այդ թվում նաև մի շարք աղմկահարույց դեպքերի, կալանքի սանկցիաների այդքան էլ վստահ չեմ, որ այդ օբեկտիվությունը և արդարությունը բոլոր դեպքերում կպահպանվի։ Կոնկրետ դեպքի մասով չեմ կարող ասել օբեկտիվություն կպահպանվի թե ոչ, բայց ընդհանուր իմ դիտարկումները այդ համատեքստում այդքան էլ մխիթարելի չեն։ Իհարկե կան առանձին այդ ոլորտում և՛ պատշաճ, և՛ իրենց գործից հասկացող ու նվիրված մարդիկ, բայց համակարգային մոտեցումները, կարծում եմ, այդ թվում նաև օրենսդիր և գործադիր իշխանությունների կողմից անհարկի միջամտությունները և ռեպլիկները, մեկնաբանությունները հաստատ չեն նպաստում մեր երկրում իրավական մասնագիտացված կառույցի և անկախ դատական համակարգի կայացմանը։
