Հայաստանի և Սինգապուրի ռեզիդենտները հնարավորություն կունենան ազատվել կրկնակի հարկումից

ՀՀ ազգային ժողովը քննարկեց Հայաստանի և Սինգապուրի միջև նոր համաձայնագիր, որով նախատեսվում է երկու երկրների ռեզիդենտ կազմակերպությունների համար բացառել կրկնակի հարկումը:
«Արմենպրես»-ի հաղորդմամբ՝ «Հայաստանի Հանրապետության կառավարության եւ Սինգապուրի Հանրապետության կառավարության միջեւ եկամուտների կրկնակի հարկումը բացառելու եւ հարկումից խուսափելն ու շրջանցելը կանխելու մասին» համաձայնագիրը վավերացնելու մասին նախագիծն ԱԺ նիստում ներկայացրեց ՀՀ ֆինանսների փոխնախարար Արման Պողոսյանը:
«Հետապնդվում է 3 հիմնական նպատակ,առաջին՝ հնարավորություն ընձեռել, որ գործուն մեխանիզմներով 2 երկրների ռեզիդենտները հնարավորություն ունենան ազատվել կրկնակի հարկումից: Երկրորդ՝ առաջարկվում են ավելի նվազ դրույքաչափեր, քան համաձայնագրի կողմ հանդիսացող երկրների ազգային օրենսդրությամբ սահմանված հարկման դրույքաչափերն են: Ակնկալվում է փոխադարձաբար խրախուսել ձեռնարկատիրական գործունեության իրականացումը: Եվ երրորդ՝ ստեղծել ավելի կայուն ու կանխատեսելի հարկային միջավայր»,-նշեց Պողոսյանը:
Որպես սկզբունք՝ ամրագրվել է, որ հիմնական եկամուտները ենթակա են հարկման ստացողի ռեզիդենտության երկրում՝ դրանք լինեն ձեռնարկտիրական, թե պասիվ եկամուտներ:
Սակայն հիմնական կանոնից նաև բացառություններ կան: Առաջինը վերաբերում է ձեռնարկատիրական եկամուտներին: Եթե պայմանավորվող կողմի ռեզիդենտի ձեռնարկատիրական գործունեությունն իրականացվում է մյուս պայմանավորվող պետությունում մշտական հաստատության ձևավորմամբ, ապա այդ դեպքում հյուրընկալող երկիրն իրավունք է ստանում հարկել այդ ձեռնարկատիրական եկամուտները, իսկ եթե ոչ՝ ապա միայն ռեզիդենտության երկիրն է այդ հնարավորությունը ստանում: Պասիվ եկամուտների դեպքում նաև նախապատվության իրավունքը տրված է վճարման աղբյուր համարվող երկրին, և գործնականում երկրներն օգտվում են իրենց այս նախապատվության իրավունքից:
Պասիվ եկամուտներից տոկոսների, ռոյալթիների համար նախատեսված է ազգային օրենսդրությամբ սահմանված 10 տոկոսի համեմատությամբ ավելի ցածր՝ 5 տոկոս դրույքաչափ, շահաբաժինների պարագայում՝ 0 տոկոս:
Այսպիսով, համաձայնագիրը նպատակ ունի բացառել կրկնակի հարկումը պետություններից մեկում կամ երկուսում հարկման ենթակա անձանց կամ ընկերությունների ծավալած գործունեությունից ստացվող եկամուտներից գանձվող հարկերի առնչությամբ:
