Ադրբեջանը խախտել է հայ գերիների կյանքի իրավունքը. ՄԻԵԴ-ն Ադրբեջանին պարտավորեցրել է Մամիկոն Խոջոյանի և Կարեն Պետրոսյանի գործով 40 000-ական եվրո վճարել

Մարդու իրավունքների եվրոպական դատարանը հրապարակել է «Պետրոսյանն ընդդեմ Ադրբեջանի» և «Խոջոյանն ու Վարդազարյանն ընդդեմ Ադրբեջանի» գործերով վճիռները: Խոսքը 2014 թվականի 28-ին Ադրբեջանում գերեվարված, ապա խոշտանգված՝ Տավուշի մարզի Վերին Կարմիրաղբյուր գյուղի բնակիչ Մամիկոն Խոջոյանի և 2014-ի օգոստոսի 7-ին Ադրբեջանում գերեվարված՝ Չինարի գյուղի բնակիչ Կարեն Պետրոսյանի մասին է:
Մամիկոն Խոջոյանի դեպքում, որը մահացել է 2019-ին, հայցվորներն են նրա ընտանիքի անդամները:
Մինչդեռ Կարեն Պետրոսյանի դեպքում հայցվորը նրա հայրն է՝ Արտուշ Պետրոսյանը: Երկուսի պարագայում էլ ադրբեջանական կողմը պնդելը, որ խոսքը դիվերսիոն ներթափանցման մասին է, չնայած, որ գերեվարվածները քաղաքացիական անձինք են եղել:
Եվրադատարանը ճանաչել է, որ Բաքուն խախտել է հայ գերիների կյանքի իրավունքը, խոշտանգումներից, խտրականությունից զերծ մնալու, ազատության, անձնական անձեռնմխելիության իրավունքները:
ՄԻԵԴ-ի՝ «Պետրոսյանն ընդդեմ Ադրբեջանի» վճռում ասվում է, որ բավարար ապացույցներ այն մասին, որ դիմումատուի որդին մինչև մահը կալանքի տակ ենթարկվել է ծանր ֆիզիկական բռնության: Բացի այդ, նշվում է, որ չի իրականացվել արդյունավետ հետաքննության, ներառյալ՝ արդյոք ազգամիջյան ատելությունը դեր է խաղացել:
Իսկ «Խոջոյանն ու Վարդազարյանն ընդդեմ Ադրբեջանի» գործով ՄԻԵԴ-ի վճռում նշվում է, որ կալանավայրում վերաբերմունքը Խոջոյանի նկատմամբ հավասար է եղել խոշտանգումների, կիրառվել է անմարդկային և նվաստացնող վերաբերմունք, ինչպես նաև ապօրինի կալանք:
ՄԻԵԴ-ը պարտավորեցրել է Ադրբեջանին յուրաքանչյուր գործով վճարել 40 000 եվրո:
77-ամյա Մամիկոն Խոջոյանը գերեվարվել էր 2014-ի հունվարին, երկու ամիս անց՝ մարտի 4-ին, նա Հայաստան էր վերադարձվել, որոշ ժամանակ անց՝ մահացել: Դատաբժշկական փորձաքննությունը ցույց էր տվել, որ Խոջոյանի մահվան պատճառը եղել է օրգանիզմի ընդհանուր ինտոքսիկացիան:
Կարեն Պետրոսյանը 2014 թվականի օգոստոսի 7-ին էր մոլորվել, հատել սահմանը, հայտնվել ադրբեջանական գյուղում: Կարճ ժամանակ անց Ադրբեջանի իշխանությունը նրան ձերբակալել էր, հաջորդ օրը հայտարարել, որ նա մահացել է սրտի կաթվածից:
