Նոյեմբերի 15-ին Սեյրան Հայրապետյանի նախագահությամբ հրավիրվել է ԱՀ ԱԺ պաշտպանության, անվտանգության և օրինապահպանության մշտական հանձնաժողովի նիստը։ Այս մասին հաղորդում է Արցախի ԱԺ աշխատակազմը:

Նիստին ներկա էր ԱԺ նախագահի տեղակալ Գագիկ Բաղունցը։

Օրակարգում ««Զենքի մասին » օրենքում փոփոխություններ և լրացումներ կատարելու մասին »  և ««Քրեական օրենսգրքում»  լրացում կատարելու մասին » օրենքների նախագծերի փաթեթի քննարկման հարց էր։

Օրենքների նախագծերի փաթեթը ներկայացրեց ՆԳՆ ոստիկանության պետ, գնդապետ Արտեմ Հարությունյանը։

Օրենսդրական փոփոխությամբ հիմնականում առաջարկվում է՝ որսորդների հասարակական կազմակերպության անդամ քաղաքացու փոխարեն սպորտային և որսորդական ողորկ-երկարափող հրազեն ու որսորդական օդաճնշիչ զենք ձեռք բերելու իրավունք վերապահել որսորդությամբ զբաղվելու իրավունք ունեցող քաղաքացուն։ Մեկ այլ փոփոխությամբ էլ որսորդական ակոսափող հրազեն ձեռք բերելու իրավունք կվերապահվի ոչ միայն պետական ռազմականացված կազմակերպությունում ծառայող, այլ նաև նշված կազմակերպություններում երբևէ ծառայած քաղաքացուն։

Առաջարկվող փոփոխությամբ՝ որսորդական ակոսափող հրազեն ձեռք բերելու իրավունք վերապահող՝ սեփականության իրավունքով ողորկ-երկարափող որսորդական հրազեն ունենալու ժամկետը կկրճատվի  2 տարով՝ 5 տարին դարձնելով 3 տարի։

Օրինափաթեթի ընդունմամբ կսահմանափակվի  զենքի գործադրմամբ կատարված ծանր կամ առանձնապես ծանր հանցագործության համար դատվածությունը մարված (հանված) կամ  որսորդության, զենքի արտադրության, առևտրի, վաճառքի, ձեռք բերելու, փոխանցելու, հավաքածուներ կազմելու կամ դրանք ցուցադրելու, հաշվառելու, պահպանելու, կրելու, փոխադրելու, տեղափոխելու և օգտագործելու կանոնների հետ կապված վարչական իրավախախտումներ կատարած քաղաքացու զենք ձեռք բերելու իրավունքը, կհստակեցվի Արցախի Հանրապետության Նախագահի կողմից Արցախի Հանրապետությունում զենքով պարգևատրելու դեպքերը։

Քրեական օրենսգրքի «Դատվածություն» վերնագրով հոդվածում առաջարկվում է սահմանափակում նախատեսել քաղաքացիական զենք ձեռք բերելու համար:

Ոստիկանապետը նախագծերում նոր փոփոխություն է առաջարկել, որով զենքի լիցենզավորման և թույլտվության ժամկետը կսահմանվի 10տարին՝ 5 տարվա ժամկետի փոխարեն։

Օրենքների նախագծերի փաթեթի ընդունման արդյունքում օրինապահ քաղաքացիների համար կապահովվի զենք ձեռք բերելու մատչելիություն, իսկ կարգազանց քաղաքացիների համար կնախատեսվեն լրացուցիչ սահմանափակումներ:

Զեկուցողը պարզաբանումներ է տվել պատգամավորների հնչեցրած հարցերին։

Հանձնաժողովը միաձայն կողմ քվեարկեց օրենքների նախագծերի փաթեթին, և այն կներկայացվի արտահերթ նիստի քննարկմանը։
