Ինչ է սահմանում գերի ընկնելու մասին օրենքը
SOCIETYԱդրբեջանի կողմից նոյեմբերի 16-ին իրականացված սադրանքի և ռազմական գործողությունների հետևանքով կրկին գերեվարվել են հայ զինվորականներ: Ըստ պաշտոնական աղբյուրների՝ նրանց թիվը 13-ն է, իսկ ոչ պաշտոնական տեղեկություններով՝ գերեվարված անձանց թիվը ճշտվում է և այն գուցե հասնի մի քանի տասնյակի։ Երեկվանից իշխանության ներկայացուցիչների և ընդդիմադիրների քննարկման առարկան է, թե ինչպես և ինչ պայմաններում են գերեվարվել հայ զինվորականները, արդյոք հնարավորություն ունեցե՞լ են գերի չընկնելու, թե՞ ոչ, կամ գտնվելով ՀՀ սուվերեն տարածքում ինչո՞ւ չեն կրակել, որպեսզի գերի չընկնեն:
Երեկ՝ նոյմբերի 17-ին ԱԺ-Կառավարություն հարց ու պատասխանի ժամանակ վարչապետ Նիկոլ Փաշինյանը անդրադարձավ զինծառայողների գերի ընկնելու հանգամանքներին․ «Ժամանակն է, որ մենք գերեվարման յուրաքանչյուր դեպքը պատշաճ ձևով հետաքննենք, որովհետև ՀՀ զինված ուժերում ծառայություն անցնող յուրաքանչյուր անձ ունի պարտականություններ, և պետք է հստակ բոլոր դեպքերով քննվի, ի՞նչ է նշանակում գերի ընկնել, ի՞նչ հանգամանքներում։ Զինվորական կանոնագրերը հստակ սահմանում են, թե որ դեպքում է, որ գերի ընկնելը չի համարվում հանցագործություն»,-ասել էր նա:
ԼՈՒՐԵՐ․com-ն ուսումնասիրել է ՀՀ Քրեական օրենսգիրքը և պարզել, որ գերի ընկնելու մասին օրենքը՝ ՔՕ 381 հոդվածը սահմանում է՝ վախկոտության կամ փոքրոգության պատճառով կամովին գերի հանձնվելը պատժվում է ազատազրկմամբ՝ 8-15 տարի ժամկետով: Եթե զինծառայողը, հայտնվելով իր զորքերից կտրված վիճակում և սպառելով դիմադրության բոլոր միջոցներն ու հնարավորությունները կամ ծանր վիրավորվածության, ծանր կոնտուզիայի հետևանքով գտնվելով անօգնական վիճակում, գերի վերցվի, պարտավոր է փնտրել և օգտագործել ամեն մի հնարավորություն իրեն և իր ընկերներին գերությունից ազատելու, իր զորքեր վերադառնալու համար: Գերի վերցված զինծառայողը հարցաքննության ժամանակ իրավունք ունի հայտնելու միայն իր անունը, ազգանունը, հայրանունը, զինվորական կոչումը, ծննդյան թիվը և անձնական համարը:
Նկատենք, որ եթե մինչ այս գերիներին հերոսացնելու թեզն էր առաջ տարվում, ապա հիմա կարծեք թե հակառակ պրոցեսն է իրականացվում։ Հասարակությունը բաժանվել է երկու մասի՝ ոմանք գերիներին շարունակում են հերոսացնել, ոմանք էլ՝ մեղադրել ու կասկածի տակ դնել գերի ընկնելու հանգամանքները։
