«Անորակ հրթիռների» գործով անցնող ՊՆ նախկին պաշտոնյաների և Հայաստանի զենքի մատակարար Դավիթ Գալստյանի (Պատրոն Դավիթ) երկամսյա կալանքի ժամկետները լրանում են:

Այս առիթով 168.am-ը զրուցել է Գալստյանի փաստաբան Արմեն Հարությունյանի հետ՝ պարզելու, թե ինչ ակնկալիքներ ունեն դատարանից:

– Կալանքի հետ կապված գործերը սկսել են քննել նոր նշանակված դատավորները նոր ձևավորված դատարանում, և եթե ներկայացվի կալանքի ժամկետը երկարացնելու միջնորդություն, այն նույնպես քննելու են նոր նշանակված դատավորները։ Մեզ հետ զրույցում Դուք մտավախությանը զուգահեռ՝ հույս էիք հայտնել, որ նորանշանակ դատավորները կլինեն իրականում անկախ, կկատարեն օբյեկտիվ քննություն և կկայացնեն հիմնավորված որոշումներ՝ անդրադառնալով պաշտպանական կողմի ներկայացրած փաստարկներին։ Մեր ունեցած տեղեկություններով, երեկ Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի Աջափնյակի նստավայրում տեղի է ունեցել «անորակ հրթիռների» գործով անցնող Դավիթ Գալստյանի կալանքի ժամկետը երկարացնելու միջնորդության քննարկումը, ի՞նչ ապացույցներ է ներկայացրել պաշտպանական կողմը:

– Այո, երեկ Երևան քաղաքի առաջին ատյանի ընդհանուր իրավասության դատարանի Աջափնյակի նստավայրում տեղի է ունեցել Դավիթ Գալստյանի կալանքի ժամկետը երկարացնելու միջնորդության քննարկումը։ Դատարանին և նախաքննության մարմնին պաշտպանական կողմը ներկայացրել է անհերքելի ապացույցներ, որով հաստատվում է մեղադրանքի անհիմն լինելը։

Մասնավորապես, դատարանին է ներկայացվել եվրոպական սպառազինության արտադրության մեջ մեծ փորձ ունեցող հեղինակավոր մասնագետի գրավոր կարծիք։ Վերջինս մասնագիտորեն հղում անելով մասնագիտական գրականությանը և համապատասխան իրավական ակտերին, ներկայացրել է բոլոր հարցերի պատասխանները կապված խնդրո առարկա հրթիռների հետ։ Բացի այս, դատարանին է ներկայացվել նաև ՊՆ-ին կատարված հարցումների պատասխանները։ Այս ապացույցներով հաստատվել են գործի օբյեկտիվ քննության համար անհրաժեշտ կարևոր տվյալներ։ Ամենակարևորը այն է, որ հաստատվել է՝ հրթիռները երբևէ որևէ խնդիր որակի հետ կապված չեն ունեցել։

Հուսով եմ, դատարանները պատշաճ գնահատական կտան այս ապացույցներին։ Իհարկե, հասկանում ենք, որ դա այդքան հեշտ չէ, դրա համար դատարանը պետք է լինի անկախ, անաչառ, չենթարկվի որևէ ճնշման և իրականացնի իրական արդարադատություն, այլ ոչ թե ստանձնի նախաքննության մարմինների ուզած դերը՝ «պեչատող», առանց խորանալու գործի էության մեջ։ Հրապարակումը տեղի կունենա այսօր։ Մեր առաջին փորձն է նորաստեղծ դատարանում, նոր նշանակված դատավորի մոտ։ Տեսնենք։
