«Կինոն» չստացվեց. Տեր-Հովսեփյանի բողոքի քննությունը հետաձգվեց

Այսօր Կենտրոն եւ Նորք-Մարաշ ընդհանուր իրավասության դատարանում պետք է լսվեր ՀԽՍՀ նախկին գլխավոր դատախազ Սուրեն Օսիպյանի որդի Վիկտոր Տեր-Հովսեփյանի բողոքը՝ ռուս գործարարներին շորթելու փաստերով քրեական գործ հարուցելու դատախազության որոշման վերաբերյալ: Սակայն նիստը, որ նշանակված էր ժամը 10:30-ին, տեղի չունեցավ: Դատավոր Արմեն Բեկթաշյանը մեկ այլ նիստի շրջանակներում վճիռ կայացնելու նպատակով փակվել էր խորհրդակցական սենյակում: Ուշագրավ է, որ դատարան էին ներկայացել միայն ռուս գործարարների շահերի ներկայացուցիչները, այդ թվում՝ «Վելես» ՀԿ-ի իրավաբանները: Տեր-Հովսեփյանի որեւէ ներկայացուցիչ դատարան չէր եկել այն դեպքում, երբ բողոքը ներկայացրել են հենց իրենք:
 
Կարելի է ենթադրել, որ նրանք նախապես գիտեին դատական նիստի հետաձգման վերաբերյալ:
 
Հիշեցնենք, որ Տեր-Հովսեփյանի շահերի ներկայացուցիչ, փաստաբան Լուսինե Մարտիրոսյանը նախորդ նիստում առանց հիմքի լրագրողներից պահանջում էր չլուսանկարել եւ չտեսանկարահանել իրեն: Այս անգամ նույնպես, «կինոն» չստացվեց:
 
Վիկտոր Տեր-Հովսեփյանի բողոքի լսումը տեղափոխվեց հունվարի 14-ին: Հիշեցնենք, որ Հայաստանում մեծ գումարներ ներդրած ռուս գործարարներ Ալեքսեյ Կորեպանովը, Դմիտրի Աֆոնինը եւ Դմիտրի Կոտովը փորձում են իրավական պատասխանատվության ենթարկել Վիկտոր Տեր-Հովսեփյանին, ով, գործարարների խոսքով, իրենցից յուրացրել է 5 միլիոն դոլարի չափով գումար: Իսկ Տեր-Հովսեփյանը, առայժմ գործին ներգրավված լինելով ոչ թե վկայի կարգավիճակով, բողոքարկել է դատախազության՝ ռուս գործարարների ցուցմունքների եւ ներկայացրած փաստերի հիմքով քրեական գործ հարուցելու որոշումը:
 
Ռուս գործարարների դիմումների հիման վրա ՀՀ Քննչական կոմիտեի Կենտրոնի բաժնում օտարերկրյա ներդրողներին խարդախության զոհ դարձնելու դեպքերի առիթով հարուցվել է քրեական գործ՝ առանձնապես խոշոր չափերով խարդախություն կատարելու փաստի առթիվ (ՀՀ քրեական օրենսգրքի 178 հոդվածի 3-րդ մասի 1-ին կետ): Դատական նիստին մեծ ուշադրությամբ հետեւում է Հայաստանում Ռուսաստանի Դաշնության դեսպանությունը, եւ ինչպես նախորդ, այնպես էլ այս անգամ դատարան էր «գործուղվել» դեսպանության բարձրաստիճան ներկայացուցիչ: ՌԴ դեսպանությունը հետաքրքրված է իր քաղաքացիների շահերի պաշտպանությամբ եւ անգամ նամակով դիմել է ՀՀ իրավապահ մարմիններին՝ պահանջելով ՌԴ քաղաքացիների շահերի լիարժեք պաշտպանություն:
